  1                                   A JOINT MEMORIAL
  2    TO THE PRESIDENT OF THE UNITED STATES, TO THE SENATE AND HOUSE OF  REPRESENTA-
  3        TIVES OF THE UNITED STATES IN CONGRESS ASSEMBLED, AND TO THE CONGRESSIONAL
  4        DELEGATION  REPRESENTING  THE STATE OF IDAHO IN THE CONGRESS OF THE UNITED
  5        STATES.
                                                                        
  6        We, your Memorialists, the House of Representatives and the Senate of  the
  7    State  of  Idaho  assembled in the Second Regular Session of the Fifty-seventh
  8    Idaho Legislature, do hereby respectfully represent that:
                                                                        
  9        WHEREAS, the United States of America  became  an  independent,  sovereign
 10    nation  for  reasons  expressed  in the Declaration of Independence and as the
 11    result of a bloody War of Independence; and
 12        WHEREAS, the Constitution of the United States of America is,  and  right-
 13    fully must remain, the supreme law of the land; and
 14        WHEREAS,  the  Constitution  of  the United States of America provides for
 15    limited, nondelegable and diffuse powers of  government  which  are  separated
 16    among the Congress, the President and the Judiciary; and
 17        WHEREAS,  the  Constitution  of the United States of America preserves the
 18    powers and duties of the individual states; and
 19        WHEREAS, the Constitution of the United States of America guarantees  per-
 20    sonal liberties of each individual citizen; and
 21        WHEREAS,  the  American system of government is based on the "self-evident
 22    truth" that "men...are endowed by their Creator" with rights that  no  govern-
 23    ment can justly abrogate; and
 24        WHEREAS,  the United Nations' Universal Declaration of Human Rights claims
 25    power to limit the exercise of basic rights and states  that  no  "rights  and
 26    freedom may be exercised contrary to the purposes and principles of the United
 27    Nations"; and
 28        WHEREAS,  the  Charter of the United Nations falsely purports to supersede
 29    the independence and sovereignty of the United States and the Constitution  of
 30    the United States of America and usurp powers delegated therein, to wit:
 31        (1)  By  concentrating  in the Security Council control and use of certain
 32        American military personnel and  the  military  personnel  of  all  member
 33        nations  for  its own purposes without any accountability, in violation of
 34        the exclusive power of Congress to declare war; and
 35        (2)  By seeking authority to tax citizens of  the  United  States  and  of
 36        other member nations directly to support United Nations activities; and
 37        (3)  By  sponsoring  an  International  Criminal  Court which violates the
 38        rights of the accused as well as the Constitution of the United States, in
 39        that it:
 40             (a)  Has no legitimate judicial authority and lacks any body of  laws
 41             by  which to adjudicate cases, the authority to enact such laws rest-
 42             ing exclusively with sovereign nations; and
 43             (b)  Merges the functions of  prosecutor  and  adjudicator  into  one
 44             office, contrary to the Constitution of the United States; and

  1             (c)  Fails  to  provide  any  appeal  from adjudications at the trial
  2             level; and
  3             (d)  Fails to provide for a trial by a jury of the  accused's  peers;
  4             and
  5             (e)  Fails to require that the accused be confronted by his accusers,
  6             providing instead for the use of hearsay testimony; and
  7             (f)  Fails to provide for the accused the right to compel the produc-
  8             tion of witnesses; and
  9             (g)  Allows evidence obtained from the accused by compulsion; and
 10             (h)  Denies other fundamental rights recognized in the constitutional
 11             jurisprudence of the United States of America.
 12        WHEREAS,  the  General  Assembly  of the United Nations continues to place
 13    rogue, terrorist nations such as Cuba, Libya and Syria in positions of member-
 14    ship and leadership on its Human Rights Commission, in defiance  of  norms  of
 15    common decency, morality and justice; and
 16        WHEREAS,  the  flaws  and  founding precepts of the United Nations are the
 17    antithesis of this nation's independence and  sovereignty,  its  Constitution,
 18    and basic principles of justice and human dignity to the point that the United
 19    Nations  is incapable of restructuring or reformation to correct the aforesaid
 20    flaws.
 21        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 22    sion  of the Fifty-seventh Idaho Legislature, the House of Representatives and
 23    the Senate concurring therein, that we forcefully and  respectfully  urge  the
 24    Idaho  delegation  in  the United States Congress to support enactment of H.R.
 25    1146, a bill before Congress to have the United States withdraw fully and com-
 26    pletely from the United Nations, and further to cease forthwith  any  and  all
 27    funding  of  the United Nations and any of its agencies, or any group with any
 28    association therewith whatsoever.
 29        BE IT FURTHER RESOLVED that the Chief Clerk of the  House  of  Representa-
 30    tives  be, and she is hereby authorized and directed to forward a copy of this
 31    Memorial to the President of the United States, to the President of the Senate
 32    and the Speaker of the House of Representatives of Congress, and the  congres-
 33    sional  delegation  representing  the  State  of  Idaho in the Congress of the
 34    United States.

                       STATEMENT OF PURPOSE
                             RS 13866
     The purpose of this memorial is to request our Congressional
Delegation to withdraw fully and completely from the United
Nations and cease forthwith any and all funding of the United
Nations and any of its agencies.
