2 PROPOSING AN AMENDMENT TO SECTION 8, ARTICLE III, OF THE CONSTITUTION OF THE
3 STATE OF IDAHO, RELATING TO SESSIONS OF THE LEGISLATURE AND THE CONVENING
4 DATE OF THE SESSION, TO CHANGE THE SESSIONS OF THE STATE LEGISLATURE FROM
5 ANNUAL TO BIENNIAL, AND TO PROVIDE FOR THE CONVENING OF THE BIENNIAL SES-
6 SION ON THE SECOND MONDAY AFTER THE FIRST DAY OF JANUARY OF EACH ODD-NUM-
7 BERED YEAR, UNLESS A DIFFERENT DAY SHALL HAVE BEEN APPOINTED BY LAW, AND
8 AT OTHER TIMES WHEN CONVENED BY THE GOVERNOR; STATING THE QUESTION TO BE
9 SUBMITTED TO THE ELECTORATE; DIRECTING THE LEGISLATIVE COUNCIL TO PREPARE
10 THE STATEMENTS REQUIRED BY LAW; AND DIRECTING THE SECRETARY OF STATE TO
11 PUBLISH THE AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW.
12 Be It Resolved by the Legislature of the State of Idaho:
13 SECTION 1. That Section 8, Article III, of the Constitution of the State
14 of Idaho be amended to read as follows:
15 SECTION 8. SESSIONS OF LEGISLATURE. The sessions of the legis-
16 lature shall be held annually biennially at the capital of the state,
17 commencing on the second Monday after the first day of January of
18 each odd-numbered year, unless a different day shall have been
19 appointed by law, and at other times when convened by the governor.
20 SECTION 2. The question to be submitted to the electors of the State of
21 Idaho at the next general election shall be as follows:
22 "Shall Section 8, Article III, of the Constitution of the State of Idaho
23 be amended to change the sessions of the state legislature from annual to
24 biennial, and to provide for the convening of the biennial session on the sec-
25 ond Monday after the first day of January of each odd-numbered year, unless a
26 different day shall have been appointed by law, and at other times when con-
27 vened by the governor?".
28 SECTION 3. The Legislative Council is directed to prepare the statements
29 required by Section 67-453, Idaho Code, and file the same.
30 SECTION 4. The Secretary of State is hereby directed to publish this pro-
31 posed constitutional amendment and arguments as required by law.
STATEMENT OF PURPOSE
RS 13765
This legislation proposes an amendment to the Idaho Constitution,
relating to sessions of the legislature and the convening date of
the session. This amendment would change the sessions of the Idaho
State Legislature from annual to biennial, and to provide for the
convening of the biennial session on the second Monday after the
first day of January of each odd-numbered year.
FISCAL IMPACT
There is no fiscal impact to the general fund.
