MARRIAGE - Proposes an amendment to the Constitution of the State of Idaho
to provide that only marriage between one man and one woman at one time
shall be recognized as valid in this state and that no other relationship
shall be recognized as a marriage or its legal equivalent by the state of
Idaho or its political subdivisions, regardless of whether such
relationship is recognized by the laws of any jurisdiction outside of this

  1                                  A JOINT RESOLUTION
  2    PROPOSING AN AMENDMENT TO ARTICLE III, OF THE CONSTITUTION  OF  THE  STATE  OF
  3        IDAHO,  BY  THE ADDITION OF A NEW SECTION 28, ARTICLE III, TO PROVIDE THAT
  4        ONLY MARRIAGE BETWEEN ONE MAN AND ONE WOMAN AT ONE TIME  SHALL  BE  RECOG-
  5        NIZED  AS VALID IN THIS STATE AND THAT NO OTHER RELATIONSHIP SHALL BE REC-
  6        OGNIZED AS A MARRIAGE OR ITS LEGAL EQUIVALENT BY THE STATE OF IDAHO OR ITS
  7        POLITICAL SUBDIVISIONS, REGARDLESS OF WHETHER SUCH RELATIONSHIP IS  RECOG-
  8        NIZED  BY  THE LAWS OF ANY JURISDICTION OUTSIDE OF THIS STATE; STATING THE
  9        QUESTION TO BE SUBMITTED TO  THE  ELECTORATE;  DIRECTING  THE  LEGISLATIVE
 10        COUNCIL  TO PREPARE THE STATEMENTS REQUIRED BY LAW; AND DIRECTING THE SEC-
 11        RETARY OF STATE TO PUBLISH THE AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW.
                                                                        
 12    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
 13        SECTION 1.  That Article III, of the Constitution of the State of Idaho be
 14    amended by the addition thereto of a NEW SECTION, to be known  and  designated
 15    as  Section 28, Article III, of the Constitution of the State of Idaho, and to
 16    read as follows:
                                                                        
 17             SECTION 28.  MARRIAGE. Only marriage between  one  man  and  one
 18        woman  at  one  time  shall  be recognized as valid in this state. No
 19        other relationship shall be recognized as a  marriage  or  its  legal
 20        equivalent  by  the  state  of  Idaho  or its political subdivisions,
 21        regardless of whether such relationship is recognized by the laws  of
 22        any jurisdiction outside of this state.
                                                                        
 23        SECTION  2.  The  question to be submitted to the electors of the State of
 24    Idaho at the next general election shall be as follows:
 25        "Shall Article III, of the Constitution of the State of Idaho  be  amended
 26    by the addition of a new Section 28, to provide that only marriage between one
 27    man  and  one woman at one time shall be recognized as valid in this state and
 28    that no other relationship shall be recognized as  a  marriage  or  its  legal
 29    equivalent  by the state of Idaho or its political subdivisions, regardless of
 30    whether such relationship is recognized by the laws of any  jurisdiction  out-
 31    side of this state?".
                                                                        
 32        SECTION  3.  The Legislative Council is directed to prepare the statements
 33    required by Section 67-453, Idaho Code, and file the same.
                                                                        
 34        SECTION 4.  The Secretary of State is hereby directed to publish this pro-
 35    posed constitutional amendment and arguments as required by law.

                          STATEMENT OF PURPOSE

                                RS 13808

A joint resolution proposing an amendment to Article III of the
Constitution of the State of Idaho, by the addition of a new Section
28, to provide that only marriage between one man and one woman at one
time shall be recognized as valid in this state and that no other
relationship shall be recognized as a marriage or its legal equivalent
by the state of Idaho or its political subdivisions, regardless of
whether such relationship is recognized by the laws of any jurisdiction
outside of this state; stating the question to be submitted to the
electorate; directing the legislative council to prepare the statements
required by law; and directing the Secretary of State to publish the
amendment and arguments as required by law.


                              FISCAL IMPACT

The expected costs to place this amendment on the ballot are $40,000 to
$45,000.
