  1                                        AN ACT
  2    RELATING TO THE STATE BOARD OF EDUCATION AND THE BOARD OF REGENTS OF THE  UNI-
  3        VERSITY  OF  IDAHO;  AMENDING SECTION 33-101, IDAHO CODE, TO REFERENCE THE
  4        EXERCISE OF LEGISLATIVE POWERS BY THE LEGISLATURE OF THE STATE OF IDAHO.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 33-101, Idaho Code, be, and the  same  is  hereby
  7    amended to read as follows:
                                                                        
  8        33-101.  CREATION  OF  BOARD.  Subject to the authority and responsibility
  9    for exercise of the legislative powers of state government vested in the  leg-
 10    islature  of the state of Idaho by the constitution, fFor the general supervi-
 11    sion, governance and control of all state educational  institutions,  to  wit:
 12    University  of  Idaho,  Idaho State University, Boise State University, Lewis-
 13    Clark State College, the School for the Deaf and the Blind and any other state
 14    educational institution which may hereafter be founded, and  for  the  general
 15    supervision,  governance  and  control of the public school systems, including
 16    public community colleges, a state board of education  is  created.  The  said
 17    board  shall  be known as the state board of education and board of regents of
 18    the University of Idaho.
 19        For the purposes of section 20, article IV, of  the  constitution  of  the
 20    state of Idaho, the state board of education and all of its offices, agencies,
 21    divisions  and  departments  shall be an executive department of state govern-
 22    ment.
 23        Where the term "state board" shall hereafter appear,  it  shall  mean  the
 24    state board of education and board of regents of the University of Idaho.

Statement of Purpose / Fiscal Impact

                       STATEMENT OF PURPOSE
                             RS 13760
This legislation amends Idaho Code 33-101 to clarify that the
Constitution of the State of Idaho provides that the Idaho
Legislature establishes education policy for the State of Idaho
and that the Executive branch of state government has a
Constitutional responsibility to faithfully execute the laws of
the State of Idaho.
