]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE SENATE SENATE BILL NO. 1318 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO THE PRACTICE OF PODIATRY; AMENDING SECTION 39-1395, IDAHO CODE, TO 3 REMOVE CERTAIN MEDICAL STAFF MEMBERSHIP REQUIREMENTS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 39-1395, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 39-1395. PRACTICE OF PODIATRY -- MEDICAL STAFF MEMBERSHIP. Except as 8 otherwise provided in this section, no provision or provisions of this section 9 shall in any way change or modify the authority or power of the governing body 10 of any hospital to make such rules, standards or qualifications for medical 11 staff membership as they, in their discretion, may deem necessary or advis- 12 able, or to grant or refuse membership on a medical staff. 13 An applicant for medical staff membership may not be denied membership 14 solely on the ground that the applicant holds a license to practice podiatry 15 issued by the Idaho state board of podiatry. The criteria utilized for grant- 16 ing medical staff membership shall be reasonable and shall not discriminate 17 against podiatry. 18 The process for considering applications for medical staff membership and 19 privileges shall afford each applicant due process. 20 All applications for medical staff membership shall be acted upon within 21 one hundred twenty (120) days from the date the required information is sub- 22 mitted. 23 The accordance and delineation of clinical privileges for podiatrists 24 shall be determined on an individual basis and commensurate with the 25 applicant's education, training, experience and demonstrated competence. In 26 implementing these procedures, each hospital shall formulate and apply reason- 27 able standards that do not discriminate in the evaluation of an applicant's 28 credentials. 29A podiatrist with medical staff privileges may initiate admission, but the30admission is not complete until the history and physical is performed and31signed by a physician licensed pursuant to chapter 18, title 54, Idaho Code.A 32 member of the medical staff licensed pursuant to chapter 18, title 54, Idaho 33 Code, shall have responsibility for the overall medical care of the patient 34 while in the hospital. Arrangements for the services of a member of the medi- 35 cal staff licensed pursuant to chapter 18, title 54, Idaho Code, for the pur- 36 poses of this section shall be the sole responsibility of the admitting podia- 37 trist and not that of the hospital or any other member of the medical staff.
STATEMENT OF PURPOSE RS 13841Cl This legislation removes language in Idaho Code that requires patients admitted to an Idaho hospital on the recommendation of a licensed podiatrist, to have their required history and physical performed by a physician licensed pursuant to Chapter 18, Title 54, Idaho Code. Podiatrists are trained, qualified and licensed under Idaho Code to perform this routine examination. FISCAL IMPACT There is no fiscal impact. Contact Name: Senator J.
