1 AN ACT
2 RELATING TO CHARTER SCHOOLS; AMENDING SECTION 33-5203, IDAHO CODE, TO REMOVE
3 LIMITS ON THE NUMBER OF CHARTER SCHOOLS AND TO REQUIRE A REVIEW OF A PRO-
4 POSED CHARTER BY THE STATE DEPARTMENT OF EDUCATION.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 33-5203, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 33-5203. AUTHORIZATION -- LIMITATIONS. (1) The creation of public charter
9 schools is hereby authorized. Charter schools shall be part of the state's
10 program of public education.
11 (2) It is the intent of the legislature that the number of charter
12 schools which may be approved in each of the first five (5) years after the
13 effective date of this act be limited in number and geographic distribution in
14 accordance with the following:
15 (a) Not more than sixty (60) schools may be approved in the first five
16 (5) years after the effective date of this act, and
17 (b) Not more than twelve (12) schools may be approved in any one (1)
18 year, and
19 (c) Not more than two (2) charters per year may be granted within an edu-
20 cational classification region as established by the state board of educa-
21 tion, and
22 (d) Not more than one (1) charter may be granted for any one (1) school
23 district in a year, and
24 (e) No whole school district may be converted to a charter district or
25 any configuration which includes all schools as charter schools.
26 The legislature further finds that, notwithstanding the limitations of this
27 subsection (2), if fewer than twelve (12) charters are approved by June 1 of a
28 year, the unused allotments shall be assigned to a statewide pool for use by
29 other requesting districts. Distributions from the pool shall be made by ran-
30 dom drawing Prior to submitting a petition for a charter school to the dis-
31 trict board of trustees, the potential charter shall be submitted to the state
32 department of education for a review to assure that the charter conforms with
33 state law and policy. A written record of the review shall be returned to the
34 petitioner and shall accompany the petition when transmitted to the board of
35 trustees.
36 (3) A charter school may be formed by creating a new school or converting
37 an existing public school to charter status. No charter shall be granted under
38 this chapter which authorizes the conversion of any private or parochial
39 school to a charter school. No charter shall be granted to or operated by a
40 for-profit entity.

FISCAL IMPACT
A slight impact on the State Department of Education and
impossible to determine because the number of charter
applications is unknown.
