the selection of districts for reviews and audits; to provide for the

  2    RELATING TO THE STATE BOARD OF  EDUCATION;  AMENDING  SECTION  33-1511,  IDAHO
  3        CODE,  TO PROVIDE FOR THE BOARD'S POWER AND DUTY TO AUTHORIZE THE SUPERVI-
  4        SOR OF SCHOOL TRANSPORTATION TO CONDUCT CERTAIN REVIEWS AND AUDITS, TO SET
  5        PRIORITY FOR THE SELECTION OF DISTRICTS FOR REVIEWS AND AUDITS, TO PROVIDE
  6        FOR THE BOARD'S POWER AND DUTY TO  AUTHORIZE  THE  SUPERVISOR  TO  PROVIDE
  7        LISTS  OF  REQUIRED CORRECTIVE ACTIONS TO SCHOOL DISTRICTS, TO PROVIDE FOR
  8        THE BOARD'S POWER AND DUTY TO REQUIRE SCHOOL DISTRICTS TO SUBMIT  PROGRESS
  9        REPORTS  ON CORRECTIVE ACTIONS TO THE STATE DEPARTMENT OF EDUCATION AND TO
 10        WITHHOLD ALL OR A PORTION OF A DISTRICT'S PUPIL TRANSPORTATION  REIMBURSE-
 11        MENT FUNDING IN CERTAIN CIRCUMSTANCES AND TO PROVIDE FOR APPEALS.
                                                                        
 12    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 13        SECTION  1.  That  Section 33-1511, Idaho Code, be, and the same is hereby
 14    amended to read as follows:
                                                                        
 15        33-1511.  STATE BOARD OF EDUCATION -- POWERS AND DUTIES RELATED TO  TRANS-
 16    PORTATION.  In  addition  to powers and duties of the state board of education
 17    hereinbefore prescribed, the said state board shall:
 18        (1)  Designate a member of its staff as supervisor of  school  transporta-
 19    tion  responsible  for  a  school bus driver training program and such program
 20    shall provide for a qualified driver trainer for each school district and with
 21    such duties as the board may prescribe;
 22        (2)  Adopt, publish and distribute, and from time to time as need therefor
 23    arises amend, minimum standards for the  construction  of  school  buses,  the
 24    basis  of  which standards shall be those incorporated in the latest report of
 25    the National Conference on School Transportation, which report shall be  filed
 26    with the Idaho state police;
 27        (3)  Approve the form(s) to be used for the inspection of school buses;
 28        (4)  Authorize the supervisor of school transportation to conduct any com-
 29    bination  of  in-depth  program  reviews, fiscal audits, and reviews of annual
 30    reimbursement claims supporting documentation of each  school  district  pupil
 31    transportation program at a frequency adequate to ensure compliance with state
 32    law,  accuracy  of  data and reimbursement claims, and safety of school buses.
 33    Priority for selecting districts for review and audit shall be given to  those
 34    districts  that  exceed both the most recent annual state average reimbursable
 35    cost per mile and the state average reimbursable cost per rider as  calculated
 36    by  the  state department of education, unless the supervisor of school trans-
 37    portation determines otherwise;
 38        (5)  Authorize the supervisor of school transportation, based upon results
 39    of program reviews, fiscal audits, and spot inspections as set forth  in  sec-
 40    tion  33-1506,  Idaho  Code, to provide to school districts a list of required
 41    corrective actions, when necessary;
 42        (6)  Require school districts to submit progress reports on those  correc-
 43    tive actions developed by the supervisor of school transportation to the state

  1    department  of  education  at prescribed intervals until deficiencies are cor-
  2    rected or the corrective actions no longer apply;
  3        (7)  Withhold all or a portion of a district's pupil transportation  reim-
  4    bursement  funding in instances of noncompliance with the requirements of sub-
  5    section (6) of this section or section 33-1506, Idaho Code,  provided  that  a
  6    district  may  appeal  to the state board of education for reconsideration, in
  7    which case the state board of education may reinstate or adjust  the  withheld
  8    funds.

The Office of Performance Evaluation, in its study of pupil
transportation, recommended that the Department of Education improve
accountability of funds; ensure accurate, equitable and consistent
reporting mechanisms by all school districts; and provide resources
necessary for appropriate oversight of Idaho s pupil transportation
support program.

It is estimated that 1.8 FTEs would need to be hired to accomplish this
task and the anticipated additional cost would be $190,100. The average
saving to the State over the past ten years was $16,000 per audit and,
with the additional personnel, there could actually be a overall saving
to the state.
