SCHOOL TRANSPORTATION - Amends existing law relating to pupil
transportation to provide that the current pupil transportation model
contract developed by the State Department of Education shall be used; to
allow for addenda to meet local requirements; to require the submission of
contracts prior to signing for review and approval; to require the State
Superintendent of Public Instruction to respond within a stated time period
by notifying school districts of contract approval or changes; and to
provide for appeal to the State Board of Education.

1 AN ACT
2 RELATING TO PUPIL TRANSPORTATION; AMENDING SECTION 33-1510, IDAHO CODE, TO
3 PROVIDE THAT THE CURRENT PUPIL TRANSPORTATION MODEL CONTRACT DEVELOPED BY
4 THE STATE DEPARTMENT OF EDUCATION SHALL BE USED, TO ALLOW FOR ADDENDA TO
5 MEET LOCAL REQUIREMENTS, TO REQUIRE THE SUBMISSION OF CONTRACTS PRIOR TO
6 SIGNING FOR REVIEW AND APPROVAL, TO REQUIRE THE STATE SUPERINTENDENT OF
7 PUBLIC INSTRUCTION TO RESPOND WITHIN A STATED TIME PERIOD BY NOTIFYING
8 SCHOOL DISTRICTS OF CONTRACT APPROVAL OR CHANGES, AND TO PROVIDE FOR
9 APPEAL TO THE STATE BOARD OF EDUCATION.
10 Be It Enacted by the Legislature of the State of Idaho:
11 SECTION 1. That Section 33-1510, Idaho Code, be, and the same is hereby
12 amended to read as follows:
13 33-1510. CONTRACTS FOR TRANSPORTATION SERVICE. (1) All contracts entered
14 into by boards of trustees for the transportation of pupils shall be in writ-
15 ing in a form approved by using the current pupil transportation model con-
16 tract developed by the state department of education. School districts may
17 attach to the model contract addenda to meet local requirements. School dis-
18 tricts shall submit to the state superintendent of public instruction a copy
19 of the pupil transportation contract prior to both parties signing it, for a
20 review of legal requirements and appropriate costs and for final approval. The
21 state superintendent of public instruction shall respond to the school dis-
22 trict within twenty-one (21) calendar days of the postmarked receipt of the
23 contract by notifying the school district of contract approval or of recom-
24 mended or required changes. A school district may appeal to the state board of
25 education any changes the state superintendent requires, in which case the
26 state board may, upon review, approve the contract without such changes.
27 (2) No contract shall be executed covering a period of time exceeding
28 five (5) years. School districts shall advertise, bid and contract for all bus
29 transportation service routes at a single time, and contract with the lowest
30 responsible bidder or bidders meeting the specifications.
31 (3) Before entering into such contracts, the board of trustees shall
32 invite bids by twice giving notice as provided in section 33-402 g., Idaho
33 Code, and shall award the contract to the lowest responsible bidder.
STATEMENT OF PURPOSE
RS 14077
The Office of Performance Evaluation, in its study of pupil
transportation, recommended that the Department of Education
review and approve local contracts for pupil transportation. This
legislation incorporates their suggestion but also provides for an
appeal process to the State Board of Education should a local
district disagree with Department conclusions.
FISCAL IMPACT
Minimal cost of contract review, based on the small number of
contracts statewide and the duration of each contract.
