]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE SENATE SENATE BILL NO. 1349 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO THE STATE BOARD OF EDUCATION AND THE STATE SUPERINTENDENT OF PUB- 3 LIC INSTRUCTION; AMENDING SECTION 33-110, IDAHO CODE, TO PROVIDE THAT THE 4 STATE BOARD OF EDUCATION IS THE AGENCY DESIGNATED TO NEGOTIATE, CONTRACT 5 WITH, AND ACCEPT FINANCIAL AND OTHER ASSISTANCE FROM THE FEDERAL GOVERN- 6 MENT FOR ALL SUCH MATTERS AS PERTAIN TO HIGHER EDUCATION; AND AMENDING 7 CHAPTER 15, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 8 67-1505, IDAHO CODE, TO PROVIDE THAT THE STATE SUPERINTENDENT OF PUBLIC 9 INSTRUCTION IS THE AGENT DESIGNATED TO NEGOTIATE, CONTRACT WITH, AND 10 ACCEPT FINANCIAL AND OTHER ASSISTANCE FROM THE FEDERAL GOVERNMENT FOR ALL 11 SUCH MATTERS AS PERTAIN TO EARLY PUBLIC EDUCATION THROUGH GRADE TWELVE. 12 Be It Enacted by the Legislature of the State of Idaho: 13 SECTION 1. That Section 33-110, Idaho Code, be, and the same is hereby 14 amended to read as follows: 15 33-110. AGENCY TO NEGOTIATE, AND ACCEPT, FEDERAL ASSISTANCE. The state 16 board is designated as the state educational agency which is authorized to 17 negotiate, and contract with, the federal government, and to accept financial 18 or other assistance from the federal government or any agency thereof, under 19 such terms and conditions as may be prescribed by congressional enactment 20 designed to further the cause of education for all such matters as pertain to 21 higher education. 22 SECTION 2. That Chapter 15, Title 67, Idaho Code, be, and the same is 23 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 24 ignated as Section 67-1505, Idaho Code, and to read as follows: 25 67-1505. SUPERINTENDENT DESIGNATED AS STATE AGENT. The state superintend- 26 ent of public instruction is designated as the state educational agent who is 27 authorized to negotiate, and contract with, the federal government, and to 28 accept financial or other assistance from the federal government or any agency 29 thereof, under such terms and conditions as may be prescribed by congressional 30 enactment designed to further the cause of education for all such matters as 31 pertain to early public education through grade twelve (12).
STATEMENT OF PURPOSE RS 13883 This measure proposes to clarify and define the roles of the State Board of Education and the State Department of Education, providing that the Board of Education is the agency with authority over certain matters pertaining to higher education and the Department of Education is the agency with authority over certain matters pertaining to early public education through grade twelve. FISCAL IMPACT There is no fiscal impact to the state general fund.
