  1                                        AN ACT
  2    RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT; AMENDING  SECTION  37-2705,
  3        IDAHO  CODE,  TO INCLUDE SPORES OR MYCELIUM CAPABLE OF PRODUCING MUSHROOMS
  4        THAT CONTAIN PSILOCYBIN OR PSILOCIN IN SCHEDULE  I  CONTROLLED  SUBSTANCES
  5        AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 37-2705, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        37-2705.  SCHEDULE I. (a) The controlled substances listed in this section
 10    are included in schedule I.
 11        (b)  Any of  the  following  opiates,  including  their  isomers,  esters,
 12    ethers,  salts,  and salts of isomers, esters, and ethers, unless specifically
 13    excepted, whenever the existence of these isomers, esters, ethers and salts is
 14    possible within the specific chemical designation:
 15        (1)  Acetyl-alpha-methylfentanyl             (N-[1-(1-methyl-2-phenethyl)-
 16        4-piperidinyl]-N-phenylacetamide);
 17        (2)  Acetylmethadol;
 18        (3)  Allylprodine;
 19        (4)  Alphacetylmethadol  (except  levo-alphacetylmethadol  also  known  as
 20        levo-alpha-acetylmethadol, levomethadyl acetate or LAAM);
 21        (5)  Alphameprodine;
 22        (6)  Alphamethadol;
 23        (7)  Alpha-methylfentanyl;
 24        (8)  Alpha-methylthiofentanyl           (N-[1-methyl-2-(2-thienyl)ethyl-4-
 25        piperidinyl]-N-phenylpropanamide);
 26        (9)  Benzethidine;

 38    chemical designation:
 39        (1)  Acetorphine;
 40        (2)  Acetyldihydrocodeine;
 41        (3)  Benzylmorphine;
 42        (4)  Codeine methylbromide;
 43        (5)  Codeine-N-Oxide;
 44        (6)  Cyprenorphine;
 45        (7)  Desomorphine;
 46        (8)  Dihydromorphine;
 47        (9)  Drotebanol;
 48        (10) Etorphine (except hydrochloride salt);
 49        (11) Heroin;
 50        (12) Hydromorphinol;
 51        (13) Methyldesorphine;
 52        (14) Methyldihydromorphine;
 53        (15) Morphine methylbromide;
 54        (16) Morphine methylsulfonate;

  7        (d)  Hallucinogenic  substances. Any material, compound, mixture or prepa-
  8    ration which contains any quantity of the following hallucinogenic substances,
  9    their salts, isomers and salts of isomers, unless specifically excepted, when-
 10    ever the existence of these salts, isomers, and salts of isomers  is  possible
 11    within the specific chemical designation (for purposes of this paragraph only,
 12    the term "isomer" includes the optical, position and geometric isomers):
 13        (1)  4-bromo-2,5-dimethoxy amphetamine;
 14        (2)  2,5-dimethoxyamphetamine;
 15        (3)  4-bromo-2,5-dimethoxyphenethylamine      (some      other      names:
 16        alpha-desmethyl DOB, 2C-B);
 17        (4)  2,5-dimethoxy-4-ethylamphetamine (another name: DOET);
 18        (5)  4-methoxyamphetamine (PMA);
 19        (6)  5-methoxy-3,4-methylenedioxy-amphetamine;
 20        (7)  4-methyl-2,5-dimethoxy-amphetamine (DOM, STP);
 21        (8)  3,4-methylenedioxy amphetamine;
 22        (9)  3,4-methylenedioxymethamphetamine (MDMA);
 23        (10) 3,4-methylenedioxy-N-ethylamphetamine  (also  known as N-ethyl-alpha-
 24        methyl-3,4 (methylenedioxy) phenethylamine, and N-ethyl MDA, MDE, MDEA);
 25        (11) N-hydroxy-3,4-methylenedioxyamphetamine  (also  known  as  N-hydroxy-
 26        alpha-methyl-3,4(methylenedioxy) phenethylamine, and N-hydroxy MDA);
 27        (12) 3,4,5-trimethoxy amphetamine;
 28        (13) Alpha-ethyltryptamine     (some     other     names:     etryptamine,
 29        3-(2-aminobutyl) indole);
 30        (14) Bufotenine;
 31        (15) Diethyltryptamine (DET);
 32        (16) Dimethyltryptamine (DMT);
 33        (17) Ibogaine;
 34        (18) Lysergic acid diethylamide;
 35        (19) Marihuana;
 36        (20) Mescaline;
 37        (21) Parahexyl;
 38        (22) Peyote;
 39        (23) N-ethyl-3-piperidyl benzilate;
 40        (24) N-methyl-3-piperidyl benzilate;
 41        (25) Psilocybin;
 42        (26) Psilocyn;
 43        (27) Tetrahydrocannabinols. Synthetic equivalents of the  substances  con-
 44        tained  in  the  plant,  or  in  the resinous extractives of Cannabis, sp.
 45        and/or synthetic substances, derivatives, and their isomers  with  similar
 46        chemical structure and pharmacological activity such as the following:
 47            cis  or trans tetrahydrocannabinol, and their optical isomers, exclud-
 48        ing dronabinol in sesame oil and encapsulated in a soft gelatin capsule in
 49        a drug product approved by the U.S. Food and Drug Administration.
 50            cis or trans tetrahydrocannabinol, and their optical isomers.
 51            cis or trans tetrahydrocannabinol, and  its  optical  isomers.  (Since
 52        nomenclature of these substances is not internationally standardized, com-
 53        pounds  of these structures, regardless of numerical designation of atomic
 54        positions are covered.)
 55        (28) Ethylamine analog of  phencyclidine  (N-ethyl-1-phenylcyclohexylamine

  1        (1-phenylcyclohexyl)    ethylamine;   N-(1-phenylcyclohexyl)   ethylamine,
  2        cyclohexamine, PCE;
  3        (29) Pyrrolidine    analog    of    phencyclidine:    1-(phenylcyclohexyl)
  4        -pyrrolidine, PCPy, PHP;
  5        (30) Thiophene             analog             of             phencyclidine
  6        1-[1-(2-thienyl)-cyclohexyl]-piperidine, 2-thienylanalog of phencyclidine,
  7        TPCP, TCP;
  8        (31) 1-[1-(2-thienyl) cyclohexyl] pyrrolidine another name: TCPy;
  9        (32) Spores or  mycelium  capable  of  producing  mushrooms  that  contain
 10        psilocybin or psilocin.
 11        (e)  Unless  specifically  excepted  or unless listed in another schedule,
 12    any material, compound, mixture or preparation which contains any quantity  of
 13    the  following  substances  having  a depressant effect on the central nervous
 14    system, including its salts, isomers, and salts of isomers whenever the  exis-
 15    tence of such salts, isomers, and salts of isomers is possible within the spe-
 16    cific chemical designation:
 17        (1)  Gamma  hydroxybutyric  acid  (some  other  names  include GHB; gamma-
 18        hydroxybutyrate, 4-hydroxybutyrate; 4-hyroxybutanoic acid; sodium oxybate;
 19        sodium oxybutyrate);
 20        (2)  Flunitrazepam (also known as "R2", "Rohypnol");
 21        (3)  Mecloqualone;
 22        (4)  Methaqualone.
 23        (f)  Stimulants. Unless specifically excepted or unless listed in  another
 24    schedule,  any  material, compound, mixture, or preparation which contains any
 25    quantity of the following substances having a stimulant effect on the  central
 26    nervous system, including its salts, isomers, and salts of isomers:
 27        (1)  Aminorex         (some        other        names:        aminoxaphen,
 28        2-amino-5-phenyl-2-oxazoline, or 4,5-dihydro-5-phenyl-2-oxazolamine);
 29        (2)  Cathinone    (some     other     names:     alpha-aminopropiophenone,
 30        2-aminopropiophenone and norephedrone);
 31        (3)  Fenethylline;
 32        (4)  Methcathinone   (some  other  names:  2-(methyl-amino)-propiophenone,
 33        alpha-(methylamino)-propiophenone,  N-methylcathinone,   AL-464,   AL-422,
 34        AL-463 and UR1423);
 35        (5)  (t)cis-4-methylaminorex
 36        [(+/-)cis-4,5-dihydro-4-methyl-5-phenyl-2-oxazolamine];
 37        (6)  N-ethylamphetamine;
 38        (7)  N,N-dimethylamphetamine    (also   known   as:   N,N-alpha-trimethyl-
 39        benzeneethanamine).
 40        (g)  Temporary listing of substances subject to emergency scheduling.  Any
 41    material,  compound, mixture or preparation which contains any quantity of the
 42    following substances:
 43        (1)  N-[1-benzyl-4-piperidyl]-N-phenylpropanamide  (benzylfentanyl),   its
 44        optical isomers, salts and salts of isomers.
 45        (2)  N-[1-(2-thienyl)methyl-4-piperidyl]-N-phenylpropanamide
 46        (thenylfentanyl), its optical isomers, salts and salts of isomers.
 47        (3)  4-methylaminorex      (also      known      as      2-amino-4-methyl-
 48        5-phenyl-2-oxazoline).

Statement of Purpose / Fiscal Impact


                    STATEMENT OF PURPOSE 
                           RS 13869

Psilocybin and psilocin are Schedule I Controlled Substances. 
This legislation adds spores or mycelium capable of producing 
mushrooms that contain psilocybin or psilocin to the list of 
Schedule I Controlled Substances.
