  1                                        AN ACT
  2    RELATING TO INDEPENDENT EXPENDITURES; AMENDING SECTION 67-6611, IDAHO CODE, TO
  3        PROVIDE THE TIME IN WHICH WRITTEN STATEMENTS SETTING FORTH CERTAIN  EXPEN-
  4        DITURES  MUST BE FILED WITH THE SECRETARY OF STATE; AND DECLARING AN EMER-
  5        GENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 67-6611, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        67-6611.  INDEPENDENT  EXPENDITURES. (1) Each person who makes independent
 10    expenditures in an aggregate amount exceeding one hundred  dollars  ($100)  in
 11    support  of  or in opposition to any one (1) candidate, political committee or
 12    measure, shall file a statement of  the  expenditure  with  the  secretary  of
 13    state.
 14        (2)  Statements  shall be filed with the secretary of state, not less than
 15    seven (7) days prior to the primary and general election and thirty (30)  days
 16    after the primary and general election.
 17        (3)  The  statement  shall contain the following information: (a) the name
 18    and address of any person to whom an expenditure in excess  of  fifty  dollars
 19    ($50.00)  has  been  made by any such person in support of or in opposition to
 20    any such candidate or issue during the reporting  period,  together  with  the
 21    amount,  date  and  purpose of each such expenditure; and (b) the total sum of
 22    all expenditures made in support of or in opposition to any such candidate  or
 23    measure.
 24        (4)  In  addition to the requirements set forth in subsections (1) and (2)
 25    of this section, each person who makes independent expenditures in  an  aggre-
 26    gate  amount  of one thousand dollars ($1,000) or more after the sixteenth day
 27    before, but more than forty-eight (48) hours before, any  primary  or  general
 28    election, shall file a written statement of the expenditure with the secretary
 29    of  state  not  less  more  than  forty-eight (48) hours from the time of such
 30    expenditure. The statement shall include the information required  in  subsec-
 31    tion (3) of this section.
                                                                        
 32        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 33    declared to exist, this act shall be in full force and effect on and after its
 34    passage and approval.

                       STATEMENT OF PURPOSE
                             RS 14099

Correct an error in SB1009 from the 2003 legislative session. 
The legislature relied upon the language provided to it in
furtherance of the disclosure time period; however, it is an
error.  Rather than reading "not less than," it should read "not
more than."  Also Section 2 is added stating "An emergency
existing therefor, which emergency is hereby declared to exist,
this act shall be in full force and effect on and after its
passage and approval".
