2 RELATING TO RETAIL SALE OF LIQUOR BY THE DRINK; AMENDING SECTION 23-953, IDAHO
3 CODE, TO FURTHER DEFINE RACING FACILITY TO INCLUDE MOTORSPORT RACING.
4 Be It Enacted by the Legislature of the State of Idaho:
5 SECTION 1. That Section 23-953, Idaho Code, be, and the same is hereby
6 amended to read as follows:
7 23-953. RACING FACILITIES -- LICENSING. Nothing contained in this chapter
8 shall prohibit the issuance of a license to the owner, operator or lessee of a
9 racing facility, even if situated outside the incorporated limits of a city. A
10 "racing facility" means an actual, bona fide racing facility located on not
11 less than twenty (20) contiguous acres with permanently erected seating of not
12 less than one thousand (1,000) capacity, and which has a license to conduct
13 pari-mutuel racing, or which conducts motorsport racing. The provisions of
14 section 23-910, Idaho Code, shall apply to licenses issued under the provi-
15 sions of this section. The fees for licenses granted under the provisions of
16 this section shall be the same as those prescribed for golf courses as set
17 forth in section 23-904, Idaho Code. Licenses issued under the provisions of
18 this section are not transferable.
STATEMENT OF PURPOSE
RS 13842
The proposed amendment would extend to auto racing venues the
same rights which horse racing tracks have to obtain a limited
liquor license. Horse racing tracks are afforded limited liquor
licenses which apply only to the race track property for which
they are issued. Auto racing venues do not presently enjoy the
same privilege, and this amendment seeks to treat both racing
venues equally for the purpose of obtaining a liquor license.
FISCAL IMPACT
The proposed amendment does not result in any increase in
expenditures from the general fund.
