  1                                        AN ACT
  2    RELATING TO THE AMERICAN HERITAGE MONUMENT; AMENDING  CHAPTER  16,  TITLE  67,
  3        IDAHO  CODE,  BY THE ADDITION OF A NEW SECTION 67-1613, IDAHO CODE, TO SET
  4        FORTH LEGISLATIVE FINDINGS, TO PROVIDE FOR THE  DISPLAY  OF  THE  AMERICAN
  5        HERITAGE MONUMENT IN THE CAPITOL BUILDING AND TO PROVIDE FOR A DESIGN COM-
  6        MITTEE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Chapter  16,  Title 67, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 67-1613, Idaho Code, and to read as follows:
                                                                        
 11        67-1613.  AMERICAN  HERITAGE MONUMENT. (1) Legislative findings. The Idaho
 12    legislature finds:
 13        (a)  The principles upon which this state and this nation were founded and
 14        which are embodied in our constitutions, laws  and  jurisprudence  were  a
 15        product  of  the  documents, writings and events referenced in these find-
 16        ings; and
 17        (b)  The seeds of our individual rights and freedoms and recognition  that
 18        earls,  barons  and  even  the  king himself must come under the law, were
 19        first set out in written legislation on June 15, 1215, in the magna carta;
 20        and
 21        (c)  On November 11, 1620, at Cape Cod in New England, the  first  written
 22        constitution  of  the American continent was set out in the mayflower com-
 23        pact; and
 24        (d)  Sir Edward Coke and Sir William  Blackstone  transmitted  to  us  the
 25        essential  principles of the English constitution, the common law, and the
 26        rule of law, which created the framework for the American legal system and
 27        inspired our constitutional freedoms; and
 28        (e)  The fundamental orders of Connecticut, established in 1638  to  1639,
 29        affirmed  the consent of the governed and the principles of representative
 30        government and are generally held to be  the  predecessor  to  the  United
 31        States constitution; and
 32        (f)  The  signers  of  the declaration of independence recognized and pro-
 33        claimed the foundational beliefs and principles of our American  heritage;
 34        and
 35        (g)  The  ten  commandments occupy a significant role in the foundation of
 36        the American legal system, as repeatedly recognized by the  United  States
 37        supreme court and other courts in the United States; and
 38        (h)  The preamble to the constitution of the state of Idaho and the decla-
 39        ration  of  rights  as  contained  in article I of the constitution of the
 40        state of Idaho recognize the fundamental principles of our American  heri-
 41        tage  as  set  forth  in  the  documents,  writings and events referred to
 42        herein; and
 43        (i)  It is important and fitting for the Idaho legislature to take  appro-

  1        priate  measures to recognize, reconfirm, educate and remind our citizenry
  2        and others of the importance of our American heritage, and the  importance
  3        of  the  documents  set  out in the above findings and their impact on the
  4        historical, cultural, and legal foundations of our nation and our state.
  5        (2)  Display of monument. To recognize, reconfirm, educate and remind our
  6    citizens and visitors of the importance of our American heritage, and to  rec-
  7    ognize  and remind our citizenry and visitors of the unique, distinct and sig-
  8    nificant impact of the documents set forth in these findings on  our  American
  9    constitutions, law and jurisprudence, there shall be created and placed in the
 10    Idaho state capitol building a permanent free-standing monument which displays
 11    language  containing  the  essence  set  forth in these findings. The monument
 12    shall be of such dimensions as shall impart to  the  citizenry  of  Idaho  and
 13    other  visitors  to  the  capitol building the historical, cultural, and legal
 14    significance of the matters displayed therein.
 15        (3)  Design committee.  Legislative council is hereby directed to  appoint
 16    an American heritage monument design committee comprised of three (3) senators
 17    and three (3) representatives to study privately-funded proposals for the cre-
 18    ation  of the monument required by and having the features established in sub-
 19    section (2) of this section. The committee shall select the appropriate design
 20    of such monument and shall, upon its completion, with an appropriate  ceremony
 21    for  its  dedication, have it placed in the state capitol building at a perma-
 22    nent location.
                                                                        
 23        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 24    declared  to  exist, this act shall be in full force and effect ten days after
 25    its passage and approval.

 The American Heritage Monument is designed to recognize, reconfirm,
educate and remind our citizens and visitors of the importance of our
American heritage, and to recognize and remind our citizenry and
visitors of the unique, distinct and significant impact of the
documents set forth in these findings on our American constitution,
law and jurisprudence.


                         FISCAL IMPACT

There is no fiscal impact.
