1 AN ACT
2 APPROPRIATING MONEYS FROM THE PERMANENT BUILDING FUND TO THE DIVISION OF PUB-
3 LIC WORKS FOR THE VARIOUS PURPOSES SPECIFIED; REAPPROPRIATING UNEXPENDED
4 MONEYS TO THE DIVISION OF PUBLIC WORKS AND DIRECTING THEIR USE; EXPRESSING
5 LEGISLATIVE INTENT CONCERNING THE USE OF MONEYS APPROPRIATED IN THIS ACT;
6 EXEMPTING THE APPROPRIATIONS FROM THE PROVISIONS OF CHAPTER 36, TITLE 67,
7 IDAHO CODE, AND FROM THE PROVISIONS OF SECTION 67-3516, IDAHO CODE; AND
8 AUTHORIZING THE USE OF TAX ANTICIPATION NOTES.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. There is hereby appropriated from the Permanent Building Fund
11 to the Division of Public Works the following amounts, or so much thereof as
12 in each case may be necessary, for the purpose of paying the cost of any land,
13 building, equipment, or the rebuilding, renovation or repair, of buildings,
14 installations, facilities or structures at the places, institutions and agen-
15 cies, or their successors, including those listed in this section. The Perma-
16 nent Building Fund Advisory Council is hereby authorized and directed to
17 anticipate revenues accruing to the Permanent Building Fund for the purpose of
18 undertaking the construction, renovation, repair and acquisitions herein
19 authorized, without delay, and to determine the priority of construction pur-
20 suant to which the work hereunder will be undertaken.

25 The Division of Public Works shall use the reappropriated amounts authorized
26 by this section for alteration and repair projects included in Section 1 of
27 this act.
28 SECTION 3. It is legislative intent that the moneys appropriated in this
29 act may be made available for matching any allocation of moneys now in exis-
30 tence or hereafter made available by agencies of the United States and/or pri-
31 vate donations; and it is further the express intention of the Legislature to
32 authorize the Division of Public Works to expend, for the purpose of paying
33 the cost of any land, building, equipment or the rebuilding, renovation or
34 repair of buildings, moneys appropriated for public works to various agencies
35 as part of the respective agency operating budgets; provided the express
36 approval by the Permanent Building Fund Advisory Council is granted to make
37 application for such moneys in each instance.
38 SECTION 4. All appropriations made herein shall be exempt from the provi-
39 sions of Chapter 36, Title 67, and Section 67-3516, Idaho Code, but shall be
40 available for expenditure only after allotment in accordance with the other
41 provisions of Chapter 35, Title 67, Idaho Code, and all appropriations made
42 hereunder shall be subject to the provisions of Section 67-5711, Idaho Code,
43 except as otherwise provided herein.
44 SECTION 5. The State Treasurer is hereby authorized and directed to
45 anticipate the revenues in the Permanent Building Fund by the issuance of tax
46 anticipation notes in accordance with authority conferred in Sections 63-3201
47 through 63-3204, Idaho Code, and in accordance with the procedures and subject
48 to the limitations provided in those sections, in the same manner as though
49 the revenues in the General Fund were being anticipated.

This is the fiscal year 2005 appropriation bill for the Permanent Building Fund in the amount of $21,337,700. This budget is funded with dedicated funds. The bill provides $16,037,700 for state-wide alteration and repair projects; $4,600,000 for the Idaho History Center, Phase 2 for the State Historical Society; and $700,000 to purchase the Department of Labor’s space in the Idaho Falls State Office Building. This bill also reappropriates unexpended moneys remaining from appropriations made for a number of projects over the past several years.
