description of the Division of Children's Programs; appropriates

6 APPROPRIATING MONEYS TO THE EDUCATIONAL SUPPORT PROGRAM/DIVISION OF
7 CHILDREN'S PROGRAMS FOR FISCAL YEAR 2005; DIRECTING THAT $4,700,000 OF THE
8 MONEYS ACCRUING PURSUANT TO SECTIONS 63-2506 AND 63-2552A, IDAHO CODE, AND

13 THE IDAHO SAFE AND DRUG-FREE SCHOOLS PROGRAM; DIRECTING THAT $2,800,000 BE
14 USED FOR THE LITERACY PROGRAMS AND EXPRESSING LEGISLATIVE INTENT THAT THE
15 STATE DEPARTMENT OF EDUCATION AND STATE BOARD OF EDUCATION COORDINATE CER-
16 TAIN PROGRAMS; DIRECTING THAT $4,850,000 BE ALLOCATED FOR PROGRAMS FOR
17 STUDENTS WITH NON-ENGLISH OR LIMITED-ENGLISH PROFICIENCY; DIRECTING THE
18 STATE BOARD OF EDUCATION TO DEVELOP A PROGRAM TO ASSIST STUDENTS TESTING
19 BELOW PROFICIENCY; DIRECTING THAT $450,000 BE DISTRIBUTED TO THE IDAHO
20 DIGITAL LEARNING ACADEMY; AND GRANTING AUTHORITY TO TRANSFER FUNDS BETWEEN
21 THE FIVE DIVISIONS OF THE EDUCATIONAL SUPPORT PROGRAM BUDGET.
22 Be It Enacted by the Legislature of the State of Idaho:
23 SECTION 1. The Public Schools Division of Children's Programs includes
24 programs that provide direct educational or material benefits to children,
25 where funding does not primarily go to paying certificated teachers and admin-
26 istrators. It also includes programs that primarily and specifically provide
27 funding for the separate instruction of identified subgroups of children out-
28 side the normal classroom of an Idaho public school. The following amounts
29 shall be expended from the listed sources for the Public Schools Division of
30 Children's Programs for the period July 1, 2004, through June 30, 2005:

36 SECTION 2. There is hereby appropriated the following amount to be trans-
37 ferred to the Public School Income Fund for the period July 1, 2004, through
38 June 30, 2005:

41 SECTION 3. There is hereby appropriated to the Educational Support
42 Program/Division of Children's Programs, pursuant to law and the provisions of

1 this act, the following amounts to be expended from the listed funds for the
2 period July 1, 2004, through June 30, 2005:

7 SECTION 4. Of the moneys appropriated in Section 3 of this act,
8 $4,700,000 shall be expended by the Superintendent of Public Instruction for
9 the Idaho Safe and Drug-Free Schools Program, from funds determined by avail-
10 able revenues accruing pursuant to Sections 63-2506 and 63-2552A, Idaho Code,
11 and other such moneys which may become available pursuant to Section 67-7439,
12 Idaho Code, for the period July 1, 2004, through June 30, 2005.
13 SECTION 5. The funds allocated for the Idaho Safe and Drug-Free Schools
14 Program in Section 4 of this act shall be distributed as follows: $250,000
15 shall be remitted to the Idaho State Police pursuant to Section 63-2552A(3),
16 Idaho Code; $100,000 may be utilized by the Superintendent of Public Instruc-
17 tion for program administration, technical assistance and evaluation. Of the
18 remaining amount, ninety-five percent (95%) shall be distributed to each
19 school district through a combination of a base amount of $1,500 and a pro-
20 rated amount based on the prior year's average daily attendance. Of the
21 remaining five percent (5%), $80,000 shall be distributed on a one-time basis
22 to the Commission on Hispanic Affairs and used to encourage and direct His-
23 panic youth away from the habitual use of tobacco, alcohol, and other drugs by
24 developing programs for schools, families and communities, with the remainder
25 used to make discretionary grants as determined by the Drug-Free Schools and
26 Communities Advisory Board.
27 SECTION 6. It is legislative intent that the Idaho Safe and Drug-Free
28 Schools Program shall include the following:
29 (1) Districts will develop a policy and plan which will provide a guide
30 for their substance abuse program.
31 (2) Districts will have an advisory board to assist each district in mak-
32 ing decisions relating to the program.
33 (3) The districts' substance abuse programs will be comprehensive to meet
34 the needs of all students. This will include prevention programs, student
35 assistance programs that address early identification and referral, and
36 aftercare.
37 (4) Districts shall submit an annual evaluation of their programs to the
38 State Department of Education as to the effectiveness of their programs.
39 SECTION 7. Of the moneys appropriated in Section 3 of this act,
40 $2,800,000 shall be used for literacy programs, as outlined in Sections
41 33-1614, 33-1615 and 33-1207A(2), Idaho Code. It is legislative intent that
42 the State Board of Education and State Department of Education coordinate fed-
43 erally funded literacy programs with state literacy programs, resulting in
44 well-coordinated, complementary literacy efforts.
45 SECTION 8. Of the moneys appropriated in Section 3 of this act,
46 $4,850,000 shall be distributed for support of programs for students with non-
47 English or limited-English proficiency, allocated to school districts pro rata
48 based upon the population of limited-English proficient students under crite-
49 ria established by the State Department of Education.

1 SECTION 9. The State Board of Education shall utilize its appropriation
2 of federal grant funds to develop a computer-based system of tutoring and
3 assistance for students failing to achieve proficiency in one (1) or more
4 areas of the Idaho Standards Achievement Test.
5 SECTION 10. Of the moneys appropriated in Section 3 of this act, $450,000
6 shall be distributed to the Idaho Digital Learning Academy, created pursuant
7 to Chapter 55, Title 33, Idaho Code.
8 SECTION 11. The State Department of Education is hereby granted the
9 authority to transfer funds between the five (5) divisions of the Educational
10 Support Program budget, in any amount necessary, to comply with the public
11 school funding provisions of appropriations and the Idaho Code.
STATEMENT OF PURPOSE
RS13422
This is the Fiscal Year 2005 appropriation for the Division of Children’s Programs portion of the Public Schools budget. The pieces of the Public Schools budget that are part of this division’s appropriation include: 1.) Border Contracts for children educated out-of-state; 2.) Exceptional Contracts/Tuition Equivalencies; 3.) Program Adjustments (funding for Booth Home); 4.) Idaho Safe & Drug-Free Schools program; 5.) Idaho Reading Initiative; 6.) Limited English Proficiency (LEP) program; 7.) Idaho Digital Learning Academy funding; and 8.) The Children’s Programs’ portion of federal pass-through funding to local school districts.
This budget adds funds for increases in Exceptional Contracts/Tuition Equivalencies, growth in Limited English Proficiency (LEP) enrollment, and an increase in available federal pass-through funds. The budget also reflects a reduction in the amount of funding necessary for the Idaho Reading Initiative, due to a reduced need for teacher training and remedial student education (fewer children are reading below grade level).
Section 9 of the bill ratifies recent decisions made by the State Board of Education, by directing the Board to use available federal funds to develop a computer-based program to help provide remedial education for students who fail to achieve full proficiency in the Idaho Standards Achievement test (ISAT).
