]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE SENATE SENATE BILL NO. 1434 BY FINANCE COMMITTEE 1 AN ACT 2 RELATING TO THE APPROPRIATION FOR THE PUBLIC SCHOOLS DIVISION OF FACILITIES; 3 APPROPRIATING FUNDS TO THE EDUCATIONAL SUPPORT PROGRAM/DIVISION OF FACILI- 4 TIES FOR FISCAL YEAR 2005; TRANSFERRING AND APPROPRIATING CERTAIN FUNDS TO 5 THE BOND LEVY EQUALIZATION FUND; TRANSFERRING AND APPROPRIATING CERTAIN 6 FUNDS TO THE SCHOOL SAFETY AND HEALTH REVOLVING LOAN AND GRANT FUND; AND 7 DIRECTING THE DISTRIBUTION OF CERTAIN FUNDS PURSUANT TO IDAHO CODE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. There is hereby appropriated to the Educational Support 10 Program/Division of Facilities, pursuant to law and the provisions of this 11 act, the following amount to be expended from the listed fund for the period 12 July 1, 2004, through June 30, 2005: 13 FROM: 14 School District Building Account $11,300,000 15 SECTION 2. The provisions of Section 33-905, Idaho Code, notwithstanding, 16 of the moneys appropriated in Section 1 of this act, $2,000,000 is hereby 17 transferred and appropriated from the School District Building Account to the 18 Bond Levy Equalization Fund. There is hereby appropriated $2,000,000 from the 19 Bond Levy Equalization Fund, to be expended pursuant to the provisions of Sec- 20 tion 33-906, Idaho Code. 21 SECTION 3. The provisions of Section 33-905, Idaho Code, notwithstanding, 22 of the moneys appropriated in Section 1 of this act, $377,500 is hereby trans- 23 ferred and appropriated from the School District Building Account to the 24 School Safety and Health Revolving Loan and Grant Fund. There is hereby appro- 25 priated $377,500 from the School Safety and Health Revolving Loan and Grant 26 Fund, to be expended pursuant to the provisions of Section 33-1017, Idaho 27 Code, notwithstanding the provisions of subsection (12) of Section 33-1017, 28 Idaho Code. 29 SECTION 4. Any moneys appropriated in Section 1 of this act that are not 30 utilized to satisfy the provisions of Sections 2 and 3 of this act shall be 31 distributed pursuant to the provisions of Section 33-905, Idaho Code.
STATEMENT OF PURPOSE

This is the Fiscal Year 2005 appropriation for the Division of Facilities portion of the Public Schools budget. The pieces of the Public Schools budget that are part of this division’s appropriation, all of which are funded with State Lottery revenues, include: 1.) Funding for the Bond Levy Equalization program; 2.) A final transfer to the School Safety & Health Revolving Loan & Grant Fund, for the second half of an interest subsidy payment due the Whitepine School District; and 3.) the regular distribution to Idaho school districts of all net remaining lottery proceeds.
