]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 122 BY HEALTH AND WELFARE COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART- 3 MENT OF HEALTH AND WELFARE RELATING TO THE MEDICAL ASSISTANCE PROGRAM. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature is vested with authority to reject executive 6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 7 that the Legislature finds that the rules are not consistent with legislative 8 intent; and 9 WHEREAS, it is the finding of the Legislature that certain rules of the 10 Department of Health and Welfare relating to the Medical Assistance Program 11 concerning investigation and audits and suspension of payments pending inves- 12 tigation, are not consistent with legislative intent and should be rejected. 13 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 14 sion of the Fifty-seventh Idaho Legislature, the Senate and the House of Rep- 15 resentatives concurring therein, that IDAPA 16.03.09, Section 204 pertaining 16 to the surveillance and utilization review committee, and Section 210 pertain- 17 ing to appeals of immediate actions, rules of the Department of Health and 18 Welfare relating to the Medical Assistance Program, adopted as pending rules 19 under Docket Number 16-0309-0308, be, and the same are hereby rejected and 20 declared null, void and of no force and effect.
STATEMENT OF PURPOSE RS 13985 This concurrent resolution would reject certain pending rules of the Department of Health and Welfare relating to the medical assistance program. The effect of this resolution, if adopted by both houses, would be to prevent the agency rules from going into effect.
