                            SENATE CONCURRENT RESOLUTION NO. 127
                                                                        
                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE  AND  REJECTING  A  CERTAIN  RULE  OF  THE
  3        DEPARTMENT OF AGRICULTURE RELATING TO LIVESTOCK MARKETING.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is the finding of the Legislature that a certain rule of the
 10    Department of Agriculture relating to livestock marketing  is  not  consistent
 11    with legislative intent and should be rejected.
 12        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 13    sion of the Fifty-seventh Idaho Legislature, the Senate and the House of  Rep-
 14    resentatives  concurring therein, that IDAPA 02.04.26, rules of the Department
 15    of Agriculture governing livestock marketing, the  entire  rulemaking  docket,
 16    adopted  as  a pending rule under Docket Number 02-0426-0301, be, and the same
 17    is hereby rejected and declared null, void and of no force and effect.

                      STATEMENT OF PURPOSE

This concurrent resolution would reject a pending rules of the 
department of agriculture relating to livestock marketing.  The
effect of this resolution, if adopted by both houses, would be to
prevent the agency rule from going into effect.

This concurrent resolution has no fiscal impact
