                            SENATE CONCURRENT RESOLUTION NO. 129

  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF  THE  IDAHO
  3        FISH AND GAME COMMISSION RELATING TO COMMERCIAL FISHING.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is  the finding of the Legislature that certain rules of the
 10    Idaho Fish and Game Commission relating to commercial fishing are not  consis-
 11    tent with legislative intent and should be rejected.
 12        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 13    sion of the Fifty-seventh Idaho Legislature, the Senate and the House of  Rep-
 14    resentatives  concurring therein, that IDAPA 13.01.12, rules of the Idaho Fish
 15    and Game Commission governing commercial fishing in the state  of  Idaho,  the
 16    entire  rulemaking  docket,  adopted  as  a  pending  rule under Docket Number
 17    13-0112-0301, be, and the same is hereby rejected and declared null, void  and
 18    of no force and effect.

Statement of Purpose / Fiscal Impact

                       STATEMENT OF PURPOSE
                             RS 14136

     This concurrent resolution would reject certain pending
rules of the Idaho Fish and Game Commission relating to
commercial fishing.  The effect of this resolution, if adopted by
both houses of the legislature, would be to prevent the agency
rule from going into effect.


                          FISCAL IMPACT

     This concurrent resolution has no fiscal impact.
