]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 480 BY NACCARATO 1 AN ACT 2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402, 3 IDAHO CODE, TO PROVIDE A CODE REFERENCE AND TO MAKE A TECHNICAL CORREC- 4 TION; AMENDING CHAPTER 4, TITLE 49, IDAHO CODE, BY THE ADDITION OF A NEW 5 SECTION 49-416A, IDAHO CODE, TO ESTABLISH AN HISTORIC LEWISTON SPECIAL 6 LICENSE PLATE PROGRAM; AND PROVIDING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 11 truck and each other motor vehicle having a maximum gross weight not in excess 12 of eight thousand (8,000) pounds shall be: 13 Vehicles one (1) and two (2) years old ............................ $48.00 14 Vehicles three (3) and four (4) years old ......................... $36.00 15 Vehicles five (5) and six (6) years old ........................... $36.00 16 Vehicles seven (7) and eight (8) years old ........................ $24.00 17 Vehicles over eight (8) years old ................................. $24.00 18 There shall be twelve (12) registration periods, starting in January for 19 holders of validation registration stickers numbered 1, and proceeding consec- 20 utively through December for holders of validation registration stickers num- 21 bered 12, each of which shall start on the first day of a calendar month and 22 end on the last day of the twelfth month from the first day of the beginning 23 month. Registration periods shall expire midnight on the last day of the reg- 24 istration period in the year designated by the validation registration 25 sticker. The numeral digit on the validation registration stickers shall, as 26 does the registration card, fix the registration period under the staggered 27 plate system of Idaho for the purpose of reregistration and notice of expira- 28 tion. 29 A vehicle that has once been registered for any of the above designated 30 periods shall, upon reregistration, be registered for the period bearing the 31 same number, and the registration card shall show and be the exclusive proof 32 of the expiration date of registration and licensing. Vehicles may be ini- 33 tially registered for less than a twelve (12) month period, or for more than a 34 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 35 tional registration tends to fulfill the purpose of the monthly series regis- 36 tration system. 37 (2) For all school buses operated either by a nonprofit, nonpublic school 38 or operated pursuant to a service contract with a school district for trans- 39 porting children to or from school or in connection with school approved 40 activities, the annual fee shall be twenty-four dollars ($24.00). 41 (3) For all motorcycles and all-terrain vehicles operated upon the public 42 highways the annual fee shall be nine dollars ($9.00). For operation of an 43 all-terrain vehicle or motorcycle off the public highways, the fee specified 2 1 in section 67-7122, Idaho Code, shall be paid. Registration exemptions pro- 2 vided in section 49-426(2) and (3), Idaho Code, apply to all-terrain vehicles 3 and motorcycles used for the purposes described in subsections (2) and (3) of 4 section 49-426, Idaho Code. 5 (4) For all motor homes the fee shall be as specified in subsection (1) 6 of this section and shall be in addition to the fees provided for in section 7 49-445, Idaho Code. 8 (5) Registration fees shall not be subject to refund. 9 (6) A financial institution or repossession service contracted to a 10 financial institution repossessing vehicles under the terms of a security 11 agreement shall move the vehicle from the place of repossession to the finan- 12 cial institution's place of business on a repossession plate. The repossession 13 plate shall also be used for demonstrating the vehicle to a prospective pur- 14 chaser for a period not to exceed ninety-six (96) hours. The registration fees 15 for repossession plates shall be as required in subsection (1) of this section 16 for a vehicle one (1) and two (2) years old. All other fees required under 17 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 18 The repossession plate shall be issued on an annual basis by the department. 19 (7) In addition to the annual registration fee in this section, there 20 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 21 program fee of fifteen dollars ($15.00) for all special license plate programs 22 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 23 49-409, 49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur- 24 suant to sections 49-406 and 49-406A, Idaho Code, there shall be an initial 25 program fee of twenty-five dollars ($25.00) but there shall be no annual 26 renewal fee. For special plates issued pursuant to sections 49-416A, 49-417, 27 49-417A, 49-417B, 49-417C, 49-418A, 49-418B, 49-418C, 49-419, 49-419A, 28 49-419B, 49-419C, 49-420, 49-420A, 49-420B, 49-420C, 49-420D,and49-420E and 29 49-420G, Idaho Code, there shall be an initial program fee of thirty-five dol- 30 lars ($35.00) and an annual program fee of twenty-five dollars ($25.00). The 31 fees contained in this subsection shall be applicable to all new special plate 32 programs. The initial program fee and the annual program fee shall be depos- 33 ited in the state highway account and shall be used to fund the cost of admin- 34 istration of special license plate programs, unless otherwise specified by 35 law. 36 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is 37 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 38 ignated as Section 49-416A, Idaho Code, and to read as follows: 39 49-416A. HISTORIC LEWISTON PLATES. (1) On and after January 1, 2005, any 40 person who is the owner of a vehicle registered under the provisions of sec- 41 tion 49-402, Idaho Code, or registered under any other section of law for 42 which the purchase of special plates is allowed, may apply for and, upon 43 department approval, receive special historic Lewiston license plates in lieu 44 of regular license plates. The provisions of this section shall not apply to 45 any vehicle with a registered maximum gross weight over twenty-six thousand 46 (26,000) pounds. Availability of historic Lewiston license plates for other 47 vehicles shall be subject to the rules, policies and procedures of the depart- 48 ment. 49 (2) In addition to the regular registration fee required in chapter 4, 50 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 51 lars ($35.00) for the initial issuance of plates, and twenty-five dollars 52 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the 53 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in 3 1 the state highway account and shall be used to fund the cost of administration 2 of this special license plate program. Twenty-five dollars ($25.00) of each 3 initial fee and fifteen dollars ($15.00) of each renewal fee shall be trans- 4 ferred by the state treasurer for deposit to the Lewiston historic preserva- 5 tion commission, and shall be used by the commission to demonstrate commit- 6 ment, through substantial educational, economic and outreach programs, to the 7 preservation and interpretation of Idaho history and Lewiston's role as 8 Idaho's first territorial capital. 9 (3) Whenever title or interest in a vehicle registered under the provi- 10 sions of this section is transferred or assigned, the owner may transfer the 11 special plates to another vehicle upon payment of the required transfer fees. 12 The owner may only display the plates on another vehicle upon receipt of the 13 new registration from the department. 14 (4) The historic Lewiston license plate shall be of a color and design in 15 accordance with the provisions of section 49-402C, Idaho Code. The design and 16 any slogan on the plate shall be acceptable to the Lewiston historic preserva- 17 tion commission and shall be approved by the Idaho transportation department 18 utilizing a numbering system as determined by the department. Initial costs of 19 the plate program, including costs of plate design, shall be paid by the Lew- 20 iston historic preservation commission. 21 (5) Sample historic Lewiston license plates may be purchased for a fee of 22 thirty dollars ($30.00), ten dollars ($10.00) of which shall be deposited in 23 the state highway account and twenty dollars ($20.00) of which shall be trans- 24 ferred to the Lewiston historic preservation commission and shall be used to 25 demonstrate commitment, through substantial educational, economic and outreach 26 programs, to the preservation and interpretation of Idaho history and 27 Lewiston's role as Idaho's first territorial capital. 28 SECTION 3. This act shall be in full force and effect on and after Janu- 29 ary 1, 2005.
STATEMENT OF PURPOSE RS 13610 In recognition to Lewiston for the role in Idaho's history, this amendment to the Idaho Code establishes a special license plate program to preserve Lewiston and the State of Idaho's history. The Historical Lewiston License Plate is associated with a demonstrated commitment to the preservation and interpretation of the first territorial Capitol and Idaho state history. The historical and cultural legacy of Idaho state history is an inalienable right of every citizen in our great state. It is the specific intention that the revenues generated from the sale of the Historic Lewiston License Plate will be used to promote historical preservation under the guidance of the Lewiston Historical Preservation Commission. The Historic Lewiston License Plate will be a source of historic preservation and revenue for the city. The city of Lewiston will apply revenues to educational, economical, and outreach components with substantial context such as; provide for speakers, presenters, and education programs teaching Idaho History in grades K-12; provide for identification and interpretation of historic buildings and other locations; provide for matching funds for historic preservation, i.e., loans and grants. The preceding examples are innovative, creative, and responsible approaches to showcasing Lewiston and the State of Idaho's historical, cultural, and natural resources.
