  1                                        AN ACT
  2    RELATING TO ELECTRICAL CONTRACTORS AND JOURNEYMEN; AMENDING  SECTION  54-1019,
  3        IDAHO CODE, TO CLARIFY QUALIFICATIONS AND RESTRICTIONS ON STATE AND MUNIC-
  4        IPAL  ELECTRICAL  INSPECTORS,  TO PROVIDE FOR ADMINISTRATION OF SUCH ADDI-
  5        TIONAL TESTS AS MAY BE ADOPTED BY THE STATE ELECTRICAL BOARD AND  TO  MAKE
  6        TECHNICAL CORRECTIONS.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section 54-1019, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        54-1019.  QUALIFICATIONS  OF  AND  RESTRICTIONS  ON  STATE  AND  MUNICIPAL
 11    INSPECTORS -- DEPUTY ELECTRICAL INSPECTORS AND THE GENERAL  INSPECTOR'S  TEST.
 12    (1)  The  administrator  of  the division of building safety shall appoint the
 13    number of deputy electrical inspectors as may be required  for  the  effective
 14    enforcement  of the provisions of this chapter. Irrespective of any other pro-
 15    vision of law or rule, all inspectors including those employed under  contract
 16    or  otherwise  assigned to enforce the provisions of this chapter whether on a
 17    full-time or part-time basis, by or on behalf of the state division of  build-
 18    ing safety or any municipality electing to claim exemption under this chapter,
 19    shall possess the following qualifications and adhere to the restrictions:
 20        (a)  Qualifications. All inspectors shall be skilled in electrical instal-
 21        lations  with not less than four (4) years of actual experience as a jour-
 22        neyman electrician, shall possess  certificates  of  competency  prior  to
 23        appointment, and shall be fully familiar with the provisions of this chap-
 24        ter  and  rules  made  both  by the administrator and the Idaho electrical
 25        board.
 26        (b)  Restrictions. No inspector  employed  by  the  division  of  building
 27        safety  and  assigned to the enforcement of the provisions of this chapter
 28        shall be engaged or financially  interested  in  an  electrical  business,
 29        trade,  practice or work, or the sale of any supplies connected therewith,
 30        nor shall he act as an agent, directly  or  indirectly,  for  any  person,
 31        firm, copartnership, association or corporation so engaged.
 32        (2)  The  administrator  of  the division of building safety shall appoint
 33    the number of deputy electrical inspectors as may be required for  the  effec-
 34    tive  enforcement  of  the  provisions of this chapter. Inspectors employed by
 35    municipalities electing to claim exemption under this chapter must possess the
 36    qualifications set forth in this section. Inspectors employed by the  division
 37    of  building safety under contract or otherwise assigned to the enforcement of
 38    the provisions of this chapter by the administrator of the division of  build-
 39    ing  safety, whether on behalf of the state division of building safety or any
 40    municipality, shall take and  pass,  before  the  end  of  their  probationary
 41    period,  the  general inspector's test administered by the educational testing
 42    service, or future such other tests developed by the educational testing  ser-
 43    vice for that purpose, or such examination developed for similar purposes, and

  1    administered  by  another testing agency, which as may be adopted by the Idaho
  2    electrical board. may select. The board may also promulgate rules relative  to
  3    the  applicability  of  this  provision to existing electrical inspectors with
  4    permanent status in the division.
