PLUMBERS - Amends and adds to existing law relating to plumbers to provide
for apprentice and specialty apprentice registration and annual renewal of
the registration; to adjust fees for a renewal certificate of competency;
to provide for prorating fees; to provide that certificates of competency
shall be issued for a period of three years; to provide for expiration and
renewal of a certificate; to authorize the Idaho Plumbing Board to provide,
by rule, for a staggered schedule of issuing and renewing certificates; and
to provide that the increase in fees for a certificate of competency and
issuance of a three-year certificate shall be effective on and after

  2    RELATING TO PLUMBING AND PLUMBERS; AMENDING CHAPTER 26, TITLE 54, IDAHO  CODE,
  3        BY  THE  ADDITION  OF  A  NEW SECTION 54-2614A, IDAHO CODE, TO PROVIDE FOR
  4        APPRENTICE AND SPECIALTY APPRENTICE REGISTRATION AND ANNUAL RENEWAL OF THE
  5        REGISTRATION; AMENDING SECTION 54-2616, IDAHO CODE, TO INCREASE  THE  FEES
  6        FOR  A  CERTIFICATE  OF  COMPETENCY  TO  REFLECT CERTIFICATES ISSUED FOR A
  7        PERIOD OF THREE YEARS; AMENDING SECTION 54-2617, IDAHO  CODE,  TO  PROVIDE
  8        THAT  CERTIFICATES  OF  COMPETENCY  SHALL  BE ISSUED FOR A PERIOD OF THREE
  9        YEARS, TO PROVIDE FOR EXPIRATION AND RENEWAL OF A CERTIFICATE,  TO  AUTHO-
 10        RIZE  THE IDAHO PLUMBING BOARD TO PROVIDE BY RULE FOR A STAGGERED SCHEDULE
 11        OF ISSUING AND RENEWING CERTIFICATES AND TO MAKE A  TECHNICAL  CORRECTION;
 12        AND PROVIDING AN EFFECTIVE DATE FOR SECTIONS 2 AND 3 OF THIS ACT.
                                                                        
 13    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 14        SECTION  1.  That  Chapter  26,  Title 54, Idaho Code, be, and the same is
 15    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 16    ignated as Section 54-2614A, Idaho Code, and to read as follows:
                                                                        
 17        54-2614A.  APPRENTICE  AND  SPECIALTY APPRENTICE REGISTRATION AND RENEWAL.
 18    Registration for an apprentice or a specialty apprentice shall  expire  twelve
 19    (12)  months from the date of issue unless renewed. An apprentice registration
 20    or specialty apprentice registration may be renewed at  any  time  during  the
 21    month  prior  to  its  expiration. Failure of any apprentice to timely renew a
 22    registration shall cause a lapse of the registration, but it  may  be  revived
 23    within one (1) year upon payment of the renewal fee.
                                                                        
 24        SECTION  2.  That  Section 54-2616, Idaho Code, be, and the same is hereby
 25    amended to read as follows:
                                                                        
 26        54-2616.  FEES FOR CERTIFICATES. Before a certificate is issued,  and  for
 27    the  renewal  thereof,  the  successful applicant shall pay to the division of
 28    building safety a fee in accordance with the following schedule:

 34        SECTION 3.  That Section 54-2617, Idaho Code, be, and the same  is  hereby
 35    amended to read as follows:
                                                                        
 36        54-2617.  CERTIFICATE  EXPIRATION -- RENEWAL -- RULES FOR STAGGERED SCHED-
 37    ULE. (1)  Certificates of competency shall be issued for a period of three (3)
 38    years, and shall expire on the 31st day of December each year three (3)  years
 39    from  the  date  of  issue,  unless  sooner revoked or suspended, and shall be

  1    renewed at any time during the month of December.
  2        (2)  A certificate of competency may be renewed at  any  time  during  the
  3    month  prior  to  its expiration. Failure of any holder to timely renew said a
  4    certificate before the last day of December of competency shall cause lapse of
  5    the certificate, but it may be revived within one (1) year without examination
  6    only upon payment of the full initial fee.
  7        (3)  The board shall promulgate rules to provide for a staggered  schedule
  8    of issuing and renewing certificates of competency.
                                                                        
  9        SECTION 4.  Sections 2 and 3 of this act shall be in full force and effect
 10    on and after January 1, 2005.

 18        (3)  The administrator of the division of building safety shall  have  the
 19    authority  to  prorate  and  assess the renewal fees as follows: the number of
 20    months the certificate will be in effect, multiplied by one-twelfth (1/12)  of
 21    the  renewal fee for that particular category of certificate. No renewal shall
 22    be issued for less than twelve (12) months.".

 24        On page 1, in line 5, delete "INCREASE" and insert: "ADJUST"; delete  line
 25    6;  in  line  7,  delete "PERIOD OF THREE YEARS" and insert: "FOR RENEWAL OF A

 13    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 14        SECTION 1.  That Chapter 26, Title 54, Idaho Code, be,  and  the  same  is
 15    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 16    ignated as Section 54-2614A, Idaho Code, and to read as follows:
                                                                        
 17        54-2614A.  APPRENTICE AND SPECIALTY APPRENTICE REGISTRATION  AND  RENEWAL.
 18    Registration  for  an apprentice or a specialty apprentice shall expire twelve
 19    (12) months from the date of issue unless renewed. An apprentice  registration
 20    or  specialty  apprentice  registration  may be renewed at any time during the
 21    month prior to its expiration. Failure of any apprentice  to  timely  renew  a
 22    registration  shall  cause  a lapse of the registration, but it may be revived
 23    within one (1) year upon payment of the renewal fee.
                                                                        
 24        SECTION 2.  That Section 54-2616, Idaho Code, be, and the same  is  hereby
 25    amended to read as follows:
                                                                        
 26        54-2616.  FEES  FOR CERTIFICATES -- PRORATING. (1) Before a certificate is

Statement of Purpose / Fiscal Impact


                     STATEMENT  OF  PURPOSE
                            RS 13522
The proposed legislation will authorize three (3)-year renewals of
plumbing certificates and amend the fee schedule pertaining to the
same.  The proposal also clarifies the renewal requirements
regarding apprentice registration.






                         FISCAL  IMPACT
There will be no fiscal impact on the general fund.  The three (3)-
year license fee will be based on present yearly fees.  The
Plumbing Bureau proposes to implement this with a staggered renewal
process.  Initially there will be an increase to the license fee
revenue for the Plumbing Bureau Dedicated Fund.  After the
implementation period one-third (1/3) of the license fees would be
received annually.
