]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 561 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO NOTICES FOR ELECTIONS; AMENDING SECTION 34-602, IDAHO CODE, TO 3 SPECIFY INFORMATION TO BE CONTAINED IN NOTICES. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 34-602, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 34-602. PUBLICATION OF NOTICES FOR PRIMARY, GENERAL OR SPECIAL ELECTIONS 8 -- CONTENTS. The several county clerks shall publish at least two (2) times, 9 the notices for any primary, general or special election. The notice shall 10 state the date of the election, the polling place in each precinct and the 11 hours during which the polls shall be open for the purpose of voting, and 12 information about the accessibility of the polling places. 13 The first notice shall be published at least twelve (12) days prior to any 14 election and the second notice shall be published not later than five (5) days 15 prior to the election. The notice of election shall be published in at least 16 two (2) newspapers published within the county, but if this is not possible, 17 the notice shall be published in one (1) newspaper published within the county 18 or a newspaper which has general circulation within the county.
STATEMENT OF PURPOSE RS 13587 This legislation requires counties to include in their notice of election, information about the accessibility of the polling places to voters with disabilities, for each election. Notice of polling place accessibility is required by the Help America Voting Act. FISCAL IMPACT This legislation will have no impact on the state general fund and minimal impact to the counties.
