  1                                        AN ACT
  2    RELATING TO THE COMMODITY INDEMNITY FUND; AMENDING SECTION 69-261, IDAHO CODE,
  3        TO REVISE COMPENSATION PROVISIONS FOR MEMBERS OF THE  COMMODITY  INDEMNITY
  4        FUND ADVISORY COMMITTEE.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section  69-261, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        69-261.  ADVISORY COMMITTEE -- TERMS -- COMPENSATION. (1) There is  hereby
  9    created  a  commodity indemnity fund advisory committee consisting of nine (9)
 10    members to be appointed by the director. Appointments shall be for up to three
 11    (3) year terms, each term ending on the same day of the same month as did  the
 12    term  preceding  it. Any member appointed to fill a vacancy occurring prior to
 13    the expiration of the term for which the member's  predecessor  was  appointed
 14    shall hold office for the remainder of the predecessor's term.
 15        (2)  The  committee  shall  be  composed  of  six  (6) producers primarily
 16    engaged in the production of commodities, and three (3) licensed bonded  ware-
 17    housemen or licensed commodity dealers.
 18        (3)  The  committee shall meet at such places and times as it shall deter-
 19    mine and as often as necessary to discharge the duties imposed upon  it,  pro-
 20    vided, it shall meet not less than twice per year. Each committee member shall
 21    be  compensated  in accordance with section 59-509(io), Idaho Code, for travel
 22    and subsistence expense. The expenses of the committee and its operation shall
 23    be paid from the commodity indemnity fund.
 24        (4)  The committee shall have the power and duty to  advise  the  director
 25    concerning  assessments,  administration  of the commodity indemnity fund, and
 26    payment of claims from the fund. Every two (2) years the committee will review
 27    the maximum limits of the fund and give advice to the director.

                       STATEMENT OF PURPOSE
                             RS 13829

                                                            
Amend Title 69, Chapter 2, Idaho Code, to compensate members of the 

Commodity Indemnity Fund Advisory Committee in accordance with 

section 59-509(o), Idaho Code, rather than section 59-509(i), Idaho 

Code. The advisory committee member's honorarium will no longer be 

considered salary as defined in section 59-1302(31), Idaho Code.


On October 10, 2003, the Commodity Indemnity Fund Advisory 

Committee voted unanimously to be compensated in accordance with 

section 59-509(o), Idaho Code, rather than section 59-509(i), Idaho 

Code.
