]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 615 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE SEED INDEMNITY FUND; AMENDING SECTION 22-5124, IDAHO CODE, TO 3 REVISE COMPENSATION PROVISIONS FOR MEMBERS OF THE SEED INDEMNITY FUND 4 ADVISORY COMMITTEE. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 22-5124, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 22-5124. ADVISORY COMMITTEE. (1) There is hereby created a seed indemnity 9 fund advisory committee appointed by the director consisting of nine (9) mem- 10 bers representing the diversity of the industry. Appointments shall be for up 11 to three (3) year terms, each term ending on the same day of the same month as 12 did the term preceding it. Any member appointed to fill a vacancy occurring 13 prior to the expiration of the term for which the member's predecessor was 14 appointed, shall hold office for the remainder of the predecessor's term. 15 (2) The committee shall be composed of seven (7) producers engaged in 16 producing seed crops and two (2) seed buyers or seed buyer representatives. 17 (3) The terms of the appointees will be staggered and the initial 18 appointments shall be three (3) producers and one (1) seed buyer for one (1) 19 year terms, two (2) producers for two (2) year terms, and two (2) producers 20 and one (1) seed buyer for three (3) year terms. 21 (4) The committee shall meet annually at such place and time as it deter- 22 mines and may meet as often as necessary to discharge the duties imposed upon 23 it. Each committee member shall be compensated in accordance with section 24 59-509(io), Idaho Code, for travel and subsistence expense. The expenses of 25 the committee and its operation shall be paid from the seed indemnity fund. 26 (5) The committee shall have the power and duty to advise the director 27 concerning assessments, administration of the seed indemnity fund, and payment 28 of claims from the fund. Every two (2) years the committee will review the 29 maximum limits of the fund and give advice to the director.
STATEMENT OF PURPOSE RS 13830 Amend Title 22, Chapter 51, Idaho Code, to compensate members of the Seed Indemnity Fund Advisory Committee in accordance with section 59-509(o), Idaho Code, rather than section 59-509(i), Idaho Code. The advisory committee member's honorarium will no longer be considered salary as defined in section 59-1302(31), Idaho Code. On October 10, 2003, the Seed Indemnity Fund Advisory Committee voted unanimously to be compensated in accordance with section 59- 509(o), Idaho Code, rather than section 59-509(i), Idaho Code.
