  1                                        AN ACT
  2    RELATING TO RETAIL SALE OF LIQUOR; AMENDING SECTION  23-955,  IDAHO  CODE,  TO
  3        PROVIDE  APPLICATION OF PROVISIONS GOVERNING SPLIT OWNERSHIP OF A FACILITY
  4        TO A GOLF COURSE AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 23-955, Idaho Code, be, and the  same  is  hereby
  7    amended to read as follows:
                                                                        
  8        23-955.  SPLIT  OWNERSHIP FACILITY -- LICENSING. Nothing contained in this
  9    chapter shall prohibit the issuance of a license to  the  owner,  operator  or
 10    lessee  of  a  premises  that has been, because of a split in ownership of the
 11    original premises, separated from a ski resort facility or golf course already
 12    licensed under the provisions of section 23-903, Idaho Code. The provisions of
 13    section 23-910, Idaho Code, shall be applicable to licenses issued pursuant to
 14    this section. The fees for licenses granted under the provisions of this  sec-
 15    tion  shall  be  the same as those prescribed for golf courses as set forth in
 16    section 23-904, Idaho Code. Licenses issued under the provisions of this  sec-
 17    tion are not transferable.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 13794
This legislation would extend to golf courses the same right
which ski resorts have to retain their liquor license privilege
in the event of a split in property ownership.  Golf courses and
ski resorts are afforded limited liquor license which apply only
to the golf course or ski resort property for which they are
issued.  This legislation would not expand, but preserve the
existing right to obtain a non-transferable license when there is
a split in ownership.
                          FISCAL IMPACT
There is no fiscal impact to the general fund.
