  1                                        AN ACT
  2    RELATING TO LICENSED PASTORAL  COUNSELORS;  AMENDING  SECTION  54-2303,  IDAHO
  3        CODE,  TO  STRIKE  REFERENCE TO PASTORAL COUNSELORS; AND REPEALING SECTION
  4        54-3405A, IDAHO CODE, TO ELIMINATE LICENSED PASTORAL COUNSELORS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 54-2303, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        54-2303.  LICENSE  REQUIRED  --  EXEMPTIONS.  It shall be unlawful for any
  9    person to practice or to offer to practice psychology, or to represent himself
 10    to be a psychologist, unless he shall first obtain a license pursuant to  this
 11    act, except as hereinafter provided.
 12        (a)  Nothing  in  this chapter shall be construed to limit the activities,
 13    and use of an official title on the part of a person in the employ of  a  fed-
 14    eral,  state,  county,  or  municipal  agency, or other political subdivision,
 15    insofar that such activities or services are a part of the duties in his sala-
 16    ried position, and insofar that such  activities  or  services  are  performed
 17    solely on behalf of his employer.
 18        (b)  Nothing  in  this  chapter shall be construed to limit the activities
 19    and services of a student, interne, or  resident  in  psychology,  pursuing  a
 20    course  of  study  approved by the board as qualifying training and experience
 21    for psychologists, provided that such activities  and  services  constitute  a
 22    part of his supervised course of study, and he is designated by such titles as
 23    "psychology  interne," "psychology trainee," or other title clearly indicating
 24    such training status. Nothing in this chapter shall be construed to limit  the
 25    activities  of  a  person employed by a duly chartered educational institution
 26    solely as an administrator, teacher, or researcher or combination  thereof  in
 27    the discharge of those duties.
 28        (c)  Nothing in this chapter shall be construed to prevent unlicensed per-
 29    sons  from providing certain services under the direct supervision and control
 30    of licensed psychologists, under such rules  as  may  be  established  by  the
 31    board.
 32        (d)  Nothing  in this chapter shall be construed to prevent qualified mem-
 33    bers of other professions such as physicians, licensed counselors,  or  social
 34    workers, or pastoral counselors from doing work of a psychological nature con-
 35    sistent  with  their  training and consistent with the code of ethics of their
 36    respective professions.
                                                                        
 37        SECTION 2.  That Section 54-3405A, Idaho Code, be, and the same is  hereby
 38    repealed.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS 14050

To repeal the licensing of Pastoral Counselors. There has been
only one such licensed counselor since the law was enacted.




                           FISCAL IMPACT



The Board of Professional Counselors will lose one license fee, but
will free of the administration of rules and consideration of
applications and renewal of licenses for Pastoral Counselors.
