]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 662 BY REVENUE AND TAXATION COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC LIBRARY DISTRICTS; AMENDING SECTION 33-2709, IDAHO CODE, TO 3 PROVIDE THAT ANY TAX-SUPPORTED CITY LIBRARY, WHETHER CONTIGUOUS OR NONCON- 4 TIGUOUS TO A LIBRARY DISTRICT, MAY JOIN AN ESTABLISHED LIBRARY DISTRICT BY 5 MAJORITY VOTE OF THE QUALIFIED ELECTORS OF THE CITY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 33-2709, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 33-2709. EXISTING TAX-SUPPORTED CITY LIBRARIES MAY JOIN LIBRARY DIS- 10 TRICTS. Any tax-supported city library, whether contiguous or noncontiguous to 11 a library district, may join an established library district by majority vote 12 of the qualified electors of the city according to procedure set forth in sec- 13 tion 33-2707, Idaho Code. A true copy of the petition and the district library 14 board's notice of approval or disapproval shall be sent to the city council. 15 When the notice carries the approval of the district library board, the city 16 council shall conduct the election and give notice of the results to the 17 library district board and the board of county commissioners. 18 If the proposal has been approved by the majority required, the board of 19 county commissioners of the home county of the district shall enter its order 20 amending the boundaries of the district, including a map drawn in a 21 draftsmanlike manner, and a copy shall be transmitted to the board of trustees 22 of the library district, to the board of county commissioners of the county in 23 which the petition arose, and to the state library board. 24 The board of trustees of the library district shall transmit a copy of the 25 order to the county recorder, the county assessor of the home county and the 26 state tax commission in a timely manner, but no later than December 15, in the 27 year in which the election was held. 28 Addition of new territory to an existing library district shall not be 29 considered an initial establishment. The existing district board of trustees 30 shall continue to serve for the terms for which elected. When a vacancy 31 occurs, appointment shall be made as provided in section 33-2716, Idaho Code.
STATEMENT OF PURPOSE RS 13914 This proposal amends Section 33-2709 Idaho Code allowing established city libraries to consolidate with established library districts that do not share a common boundary. Under the current statute, library districts and city libraries are allowed to consolidate only if they share a common boundary. The purpose for any consolidation is to foster economies of scale, maximize resources, ensure up to date materials and information. Non-contiguous consolidation would require submission of a citizen's petition requesting the question be placed on the ballot, a public election ordered by city council and agreed to by the district board of trustees, an election held on one of the consolidated election dates, and approval by a majority of voters. FISCAL NOTE No impact to the State General Fund. The fiscal effect would vary locally based upon the current library district levy rate being applied to any new city. In some instances this consolidation may lower local levy rates, as the current district library budget amount would be raised over a larger number of properties.
