  1                                        AN ACT
  2    RELATING TO THE FOREST PRACTICES ADVISORY COMMITTEE; AMENDING SECTION 38-1305,
  3        IDAHO CODE, TO INCREASE MEMBERSHIP OF THE COMMITTEE FROM EIGHT MEMBERS  TO
  4        NINE,  TO  CLARIFY MEMBERSHIP OF THE COMMITTEE, TO PROVIDE THAT ONE MEMBER
  5        SHALL BE A NONINDUSTRIAL FOREST LANDOWNER AND ONE MEMBER SHALL BE  AN  AT-
  6        LARGE MEMBER, AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section 38-1305, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        38-1305.  DUTIES, POWERS OF DEPARTMENT. The department:
 11        (1)  Shall administer and enforce this act;
 12        (2) (a)  Shall, through the director, appoint a forest practices  advisory
 13        committee  to  the  board for the purpose of providing technical advice to
 14        the board in carrying out the board's powers and duties as  set  forth  in
 15        section  38-1304,  Idaho  Code. The forest practices advisory committee is
 16        composed of eight nine (89) members, three (3) residing in the north  for-
 17        est region and three (3) residing in the south forest region,. The remain-
 18        ing  and  three  (3)  members  shall  be  residing in Idaho residents. All
 19        mMembers of the committee shall be qualified by experience and/or training
 20        to provide technical advice related to forest practices. One Of the  three
 21        (13)    members  residing  in  each forest region, one (1) member shall be
 22        either a private landowner, a private timber owner, or  authorized  repre-
 23        sentative of the landowner or timber owner who regularly engages in forest
 24        practices;.  Oone  (1)  member residing in each forest  region shall be an
 25        operator; and. Oone (1) member residing in each forest region shall  be  a
 26        representative  of  the general public. Of the remaining three (3) members
 27        who are Idaho residents: oOne (1) member shall be  qualified  by  training
 28        and  experience  as  a fisheries biologist; one (1) member shall be a non-
 29        industrial forest landowner; and one (1) member shall be an at-large  mem-
 30        ber. Members of the forest practices advisory committee shall be appointed
 31        by  the director for three (3) year terms. Appointments under this subsec-
 32        tion shall be made by the director within sixty (60) days after the effec-
 33        tive date of this section. If there is  a  vacancy,  for  any  cause,  the
 34        director shall make an appointment to become immediately effective for the
 35        unexpired term. Said appointee shall possess the same qualifications under
 36        this  act section as the person being replaced. The committee shall select
 37        a chairman from among its members. A member of  the  department  of  lands
 38        shall  be designated by the director to serve as secretary, without voting
 39        power, for the committee.
 40        (b)  Notwithstanding the terms of the committee members specified by  sub-
 41        section  (2)(a)  of  this  section, of the members first appointed to each
 42        such committee:
 43             (Ai)   Two (2) shall serve for a term of one (1) year;

  1             (Bii)  Two (2) shall serve for a term of two (2) years;
  2             (Ciii) Three (3) shall serve for a term of three (3) years.
  3        (3)  Shall advise and assist the board in the discharge of its  duties  as
  4    set forth in this act;
  5        (4)  Shall  achieve  coordination among state agencies which are concerned
  6    with the forest environment;
  7        (5)  Shall cooperate with and provide  advice  to  landowners  and  timber
  8    owners in the management of forest lands;
  9        (6)  May enter into cooperative agreement or contracts which may be neces-
 10    sary in the administration of this act;
 11        (7)  All  site-specific BMPs approved at the time of the effective date of
 12    this act shall remain in force and be enforced by the designated agency;
 13        (8)  Shall develop methods for  controlling  watershed  impacts  resulting
 14    from cumulative effects. The department shall form a cumulative effects water-
 15    shed  cooperative including, but not limited to, state and federal land manag-
 16    ing agencies and owners of industrial private  forest  land,  to  serve  as  a
 17    clearinghouse  for  comparing and evaluating shared watershed information. The
 18    director shall select an interdisciplinary task  force  including  appropriate
 19    technical  specialists and affected landowners and shall, in consultation with
 20    the task force, formulate methods for controlling cumulative effects.

Current Idaho code (38-1305) limits the size of the Forest
Practices Advisory Committee to eight members. This legislation adds
one member to the Forest Practices Advisory Committee who is a
representative of a nonindustrial forest landowner.




                         FISCAL IMPACT
                                
                                
                                
There is a small fiscal impact to cover the travel expense of this
additional member for one or two meetings per year.
