]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 728 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO TEACHERS; AMENDING CHAPTER 12, TITLE 33, IDAHO CODE, BY THE ADDI- 3 TION OF A NEW SECTION 33-1213, IDAHO CODE, TO AUTHORIZE REQUIREMENT OF 4 TECHNOLOGY PROFICIENCY, TO PROVIDE EXCEPTIONS AND TO PROVIDE THAT A WAIVER 5 PROCESS SHALL BE ADOPTED. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 12, Title 33, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 33-1213, Idaho Code, and to read as follows: 10 33-1213. TECHNOLOGY PROFICIENCY. The state board of education shall, by 11 rule, provide technology proficiency standards to apply to certificated educa- 12 tors in Idaho. At the option of the individual educator, a holder of a kinder- 13 garten through grade twelve (12) endorsement in physical education, music or 14 art, whose primary teaching assignment is in the area of the endorsement, is 15 exempt from the technology proficiency requirement. 16 The rules shall provide a process to request a waiver from the require- 17 ment, upon application for recertification, as provided in this section. A 18 letter of appeal shall be submitted to the department describing the circum- 19 stances whereby meeting the technology requirement is not applicable. The let- 20 ter shall be signed by the superintendent and chair of the board of trustees 21 of the district which employs the individual. If the superintendent or the 22 chair of the board of trustees, or both, refuse to sign the letter of appeal, 23 the individual may apply directly to the board of trustees of the district for 24 approval of the letter of appeal. If this application is disapproved, the 25 individual may apply to the state department without the endorsement of the 26 employing district. 27 A decision by the department not to grant a waiver may be appealed to the 28 state board of education. 29 Each decision on the waiver letter or application shall be determined on 30 the basis of the relevance of the technology requirements and tests to the 31 requirements of the individual's core subjects taught, teaching assignment, 32 curriculum, availability of technology equipment in the individual's classroom 33 and the individual's ability to utilize the necessary technology for such 34 tasks as recording grades and attendance.

NO. 728 1 AMENDMENTS TO SECTION 1 2 On page 1 of the printed bill, delete lines 12 through 15 and insert: 3 "tors in Idaho."; in line 31, following "assignment" delete ","; delete line 4 32; and in line 34, following "attendance." insert: "Provided however, that an 5 educator may never be granted more than one (1) waiver pursuant to the provi- 6 sions of this section, nor may any waiver granted extend beyond five (5) 7 years.". 8 AMENDMENT TO THE BILL 9 On page 1, following line 34, insert: 10 "SECTION 2. Section 1 of this act shall be null, void and of no force and 11 effect on and after July 1, 2009.". 12 CORRECTIONS TO TITLE 13 On page 1, in line 4, delete "TO PROVIDE EXCEPTIONS AND"; and in line 5, 14 following "ADOPTED" insert: "AND TO PROVIDE CERTAIN LIMITATIONS FOR WAIVERS; 15 AND TO PROVIDE A SUNSET DATE".

STATEMENT OF PURPOSE RS 14025 The purpose of this legislation is to codify, expand and clarify the technology competency requirement for certified public school employees. While the technology competency currently exists in rule, there is a need for clarity and refinement of the competency, and a need to define the waiver process.
