  1                                        AN ACT
  2    RELATING TO AGRICULTURAL BURNING; AMENDING SECTION  22-4804,  IDAHO  CODE,  TO
  3        INCREASE  FEES  RELATING  TO  THE  REGISTRATION OF FIELDS FOR AGRICULTURAL
  4        BURNING IN DESIGNATED COUNTIES; AND DECLARING AN EMERGENCY.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 22-4804, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        22-4804.  REGISTERED  COUNTIES  -- AGRICULTURAL BURNING FEES -- ACCOUNT --
  9    RULES -- RESEARCH -- MANAGEMENT PROGRAM. (1) Any person who registers a  field
 10    for agricultural burning in Kootenai, Benewah, Boundary, Bonner, Shoshone, La-
 11    tah,  Clearwater,  Nez Perce, Lewis or Idaho counties shall pay to the depart-
 12    ment a fee of one two dollars  ($12.00) per acre of cropland to be burned. The
 13    department shall remit all fees monthly to  the  state  treasurer,  who  shall
 14    deposit the moneys in the state agricultural smoke management account which is
 15    hereby created.
 16        (2)  The  department may use moneys from the agricultural smoke management
 17    account as appropriated annually by the legislature for:
 18        (a)  Research to:
 19             (i)   Develop alternative crops which do not require burning;
 20             (ii)  Improve burning and cultural  practices  for  crops  which  may
 21             require burning;
 22             (iii) Explore alternatives to burning; and
 23             (iv)  If appropriate, study and evaluate any public health impacts of
 24             burning; and
 25        (b)  Supplementation  of appropriated general account moneys for implemen-
 26        tation of agricultural smoke management  programs  referenced  in  section
 27        22-4801, Idaho Code.
                                                                        
 28        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 29    declared to exist, this act shall be in full force and effect on and after its
 30    passage and approval.

This legislation will amend Section 11-4804, Idaho Code, to
increase fees relating to the registration of fields for
agricultural burning in designated counties and provides for an
emergency clause.
     

                          FISCAL IMPACT

Approximately an additional $75,000.00 will go to the Idaho State
Department of Agriculture to be placed in a dedicated fund.
