BY APPROPRIATIONS COMMITTEE
1 AN ACT
2 APPROPRIATING MONEYS FROM THE IDAHO MILLENNIUM INCOME FUND TO THE STATE TREA-
3 SURER FOR THE PURPOSE AND PROGRAM SPECIFIED FOR FISCAL YEAR 2005; APPRO-
4 PRIATING MONEYS AND DIRECTING THE STATE CONTROLLER TO TRANSFER MONEYS FOR
5 THE PURPOSES AND PROGRAMS SPECIFIED FOR FISCAL YEAR 2005; PROVIDING LEGIS-
6 LATIVE INTENT TO THE CATASTROPHIC HEALTH CARE COST PROGRAM BOARD REGARDING
7 CERTAIN EXPENDITURES; AND PROVIDING THAT CERTAIN UNEXPENDED AND UNENCUM-
8 BERED MONEYS SHALL BE REVERTED.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. There is hereby appropriated from the Idaho Millennium Income
11 Fund to the State Treasurer $60,700 to be expended for trustee and benefit
12 payments to the Idaho American Cancer Society for the period July 1, 2004,
13 through June 30, 2005. This appropriation shall be for the use of the Magic
14 Valley Youth Tobacco-Free Coalition to develop a statewide community tobacco
15 control program.
16 SECTION 2. There is hereby appropriated and the State Controller is
17 hereby directed to make cash transfers from the Idaho Millennium Income Fund
18 to the following programs, at the request of the State Treasurer, not to
19 exceed $1,879,000 for the period July 1, 2004, through June 30, 2005:
20 (a) $500,000 for the Catastrophic Health Care Cost Program for tobacco-
21 related disease treatment as determined by a physician, by way of reducing
22 the county deductible payment pursuant to Section 3 of this act.
23 (b) $500,000 for the Bureau of Health Promotion in the Department of
24 Health and Welfare for targeted tobacco counter-marketing programs, spe-
25 cific to Idaho, and to be matched by private industry funds on at least a
26 one-to-one basis.
27 (c) $515,000 for the Public Health Districts to continue tobacco use ces-
28 sation programs statewide through the Public Health Districts of Idaho and
29 other nonprofit entities such as hospitals, primary care clinics and vol-
30 untary organizations. The tobacco use cessation programs should be avail-
31 able to any Idaho citizen, with primary emphasis on youth and pregnant
32 women.
33 (d) $270,000 for the Idaho Supreme Court for its youth courts and status
34 offender services programs as they relate to addressing tobacco and/or
35 substance abuse issues.
36 (e) $94,000 for Law Enforcement Programs in the Idaho State Police to
37 offset the cost of youth tobacco investigations.

1 SECTION 3. It is legislative intent that the Catastrophic Health Care
2 Cost Program Board use the funds appropriated in Section 2(a) of this act to
3 temporarily reduce the $10,000 deductible paid by counties for the costs of
4 caring for indigent persons with tobacco-related diseases. The Catastrophic
5 Health Care Cost Program Board shall be vested with the authority to define
6 and determine which cases qualify for the reduced county deductible, subject
7 to the provisions of this section. Notwithstanding the provisions of Chapter
8 35, Title 31, Idaho Code, the Catastrophic Health Care Cost Program Board is
9 hereby granted the authority to enact these reductions for the period July 1,
10 2004, through June 30, 2005, provided that the additional fiscal impact of
11 these reductions on the Catastrophic Health Care Cost Program shall not exceed
12 the amount appropriated in Section 2(a) of this act.
13 SECTION 4. Notwithstanding any other provision of law to the contrary, on
14 June 30, 2005, any remaining unexpended and unencumbered moneys appropriated
15 in Section 2 of this act shall be reverted to the Idaho Millennium Income
16 Fund. The State Controller shall then transfer the balance in the Idaho
17 Millennium Income Fund to the Idaho Millennium Fund.

Note: The FY 2004 original appropriation amount only represents moneys appropriated to non-governmental organizations. In order to avoid double counting the money, Millennium Fund moneys appropriated to state agencies were transferred by the State Controller from the Millennium Income Fund to the agency, and the amount was then reflected in each individual agency budget. The total amount actually appropriated from the Millennium Income Fund in FY 2004 was $2,438,700.
