]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 41 BY HEALTH AND WELFARE COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING LEGISLATIVE FINDINGS AND PROVIDING THAT THE DEPARTMENT OF HEALTH AND 3 WELFARE SHALL NEGOTIATE AND IMPLEMENT A PROCESS FOR THE REVIEW OF MEDICAID 4 REIMBURSEMENT RATES WITH PROVIDERS. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, the cost of living in Idaho has risen in excess of three percent 7 per year in recent years; and 8 WHEREAS, the annual budget allocations to Medicaid allow only cost-of- 9 living adjustments to certain Medicaid contractors or providers, but do not 10 allow for such adjustments to providers of case management, service coordina- 11 tion, mental health and developmental disability service providers; and 12 WHEREAS, the state employees, including the employees of the Department of 13 Health and Welfare, who administer the state's Medicaid Program have received 14 periodic pay increases in ten of the last thirteen years equaling a total of 15 34.4%; and 16 WHEREAS, private Medicaid providers of case management, service coordina- 17 tion, mental health and developmental disability services have been granted 18 only two cost-of-living adjustments to their rates in the past thirteen years, 19 totaling only 6.5%; and 20 WHEREAS, private providers of case management, service coordination, men- 21 tal health and developmental disability related services continue to experi- 22 ence great difficulties in recruiting and retaining qualified individuals as a 23 result of the providers' inability to offer competitive pay and benefits to 24 employees; and 25 WHEREAS, there is no defined methodology upon which Medicaid providers may 26 rely in this state for establishment of, or the periodic review of reimburse- 27 ment rates; and 28 WHEREAS, it is the desire of the Legislature of the State of Idaho to 29 ensure that contractors and providers of Medicaid services be afforded the 30 opportunity to enter into good faith discussion and review of rates and ser- 31 vice expectation on at least an annual basis with the Department of Health and 32 Welfare and officials administering the Medicaid Program. 33 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 34 sion of the Fifty-seventh Idaho Legislature, the House of Representatives and 35 the Senate concurring therein, that the Department of Health and Welfare shall 36 negotiate a process and implement a methodology under which the review of ser- 37 vice expectations, and the review of reimbursement rates for case management, 38 service coordination, developmental disability services and mental health 39 related services shall be reviewed with the specific provider groups associ- 40 ated with the provision of such services, and renegotiated when necessary, on 41 not less than an annual basis. Such methodology must result in a written sum- 42 mary of findings, which would justify whatever action or inaction may result 43 from such a review. 44 BE IT FURTHER RESOLVED that the Department of Health and Welfare shall 2 1 issue an annual report to both the Senate and the House of Representatives 2 indicating the progress made in complying with this Concurrent Resolution.
STATEMENT OF PURPOSE RS 13959 The purpose of this resolution is to give legislative direction to the Department of Health & Welfare in relation to Medicaid private providers. During times when money is tight and more demands are being placed on Medicaid private providers, it is important for good communication to be maintained between the two parties.
