  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE  AND  PROVIDING  THAT  THE  DEPARTMENT  OF
  3        ADMINISTRATION,  UPON  APPROPRIATION  OF ITS BUDGET REQUEST RELATED TO THE
  4        BORAH POST OFFICE, SHOULD TAKE THE NECESSARY STEPS TO FACILITATE AND  COM-
  5        PLETE THE ACQUISITION OF THE BORAH POST OFFICE IN THE NAME OF THE STATE OF
  6        IDAHO AND MAKE IT AVAILABLE FOR THE USE OF THE STATE.
                                                                        
  7    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  8        WHEREAS, real property located at 304 North 8th Street, and commonly known
  9    as  the Borah Post Office, is currently available to the state of Idaho, with-
 10    out monetary consideration, through the United States as federal surplus prop-
 11    erty for use pursuant to Section 203(k)(3) of the Federal Property and  Admin-
 12    istrative  Services  Act  of  1949,  as  amended (40 U.S.C. 484(k)(3)), and in
 13    accordance with the rules and regulations of the United States  Department  of
 14    the Interior; and
 15        WHEREAS,  the  property  is  comprised  of approximately 1.40 acres with a
 16    four-story building, plus  basement,  and  consists  of  approximately  79,879
 17    square feet (64,472 net rentable square feet) and 34 total parking spaces; and
 18        WHEREAS,  the  Department  of  Administration  has  submitted the required
 19    application papers to acquire the property and  has  specifically  conditioned
 20    such  application  on the approval of the Legislature of the acquisition, spe-
 21    cifically the appropriation required for operation,  maintenance  and  repair;
 22    and
 23        WHEREAS,  if  acquired,  it  is  anticipated that the state could relocate
 24    state agencies into the Borah Post Office, both  in  the  currently  available
 25    space  (approximately  26,400  square  feet)  and as current leases expire and
 26    would eventually utilize most of the space in the Borah Post  Office  for  the
 27    functions of government and to meet the state's office space needs; and
 28        WHEREAS,  the state's long-term space needs would be efficiently and cost-
 29    effectively served by the availability of the Borah Post Office.
 30        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 31    sion  of the Fifty-seventh Idaho Legislature, the House of Representatives and
 32    the Senate concurring therein, that the  Department  of  Administration,  upon
 33    appropriation  of  its budget request related to the Borah Post Office, should
 34    take the necessary steps to facilitate and complete  the  acquisition  of  the
 35    Borah  Post Office in the name of the state of Idaho and make it available for
 36    the use of the state.

                     STATEMENT  OF  PURPOSE

This concurrent resolution approves of the Department of
Administration taking necessary steps to finalize the acquisition
of the Borah Post Office from the United States, pursuant to
federal surplus property laws.  It is contemplated that the
Department of Administration would sublease available space
directly to state entities.  


                         FISCAL  IMPACT

There is no cost of acquisition as the federal statutes allow for
the conveyance without monetary consideration.  The Department of
Administration has requested spending authority of $650,000 for 
FY2005 to cover costs of operation, maintenance and repair.  
Operation, maintenance and repair costs are generated from tenant
lease payments.
