  2    TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED  STATES  IN  CONGRESS
  3        ASSEMBLED,  AND  TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
  4        IDAHO IN THE CONGRESS OF THE UNITED STATES.
                                                                        
  5        We, your Memorialists, the House of Representatives and the Senate of  the
  6    State  of  Idaho  assembled in the Second Regular Session of the Fifty-seventh
  7    Idaho Legislature, do hereby respectfully represent that:
                                                                        
  8        WHEREAS, current federal and state  medical  assistance  expenditures  for
  9    long-term  care  services  in  Idaho  exceed $145.7 million annually, with the
 10    state's annual share at approximately $43.7 million; and
 11        WHEREAS, skyrocketing costs of providing care to persons who  need  assis-
 12    tance to meet daily needs have hit the middle class particularly hard; and
 13        WHEREAS,  the national average cost for nursing home care is approximately
 14    $50,000 per year; and
 15        WHEREAS, costs to the state of Idaho will rise on  account  of  increasing
 16    demands for services as our population ages; and
 17        WHEREAS,  the purpose of the long-term care partnership program is to pro-
 18    vide incentives to individuals to purchase long-term care insurance, and  con-
 19    sequently to relieve the financial burdens on the states when they assume pay-
 20    ment for the long-term care needs of their citizens under the Medicaid program
 21    by  allowing  individuals  who exhaust qualified private long-term care policy
 22    benefits to protect an equivalent value of assets and still satisfy Medicaid's
 23    financial eligibility requirements; and
 24        WHEREAS, the concept of long-term  care  partnership  results  in  private
 25    insurance paying first and government paying last; and
 26        WHEREAS,  the  four  states  that  have had partnership plans for almost a
 27    decade, specifically California, Connecticut, Indiana and New York, have expe-
 28    rienced significant savings to taxpayers, and have seen less  than  100  total
 29    partnership purchasers qualify for Medicaid; and
 30        WHEREAS, American citizens in 46 states, the District of Columbia and ter-
 31    ritories  of  the  United  States are being discriminated against by not being
 32    able to enjoy the benefits provided by long-term care partnership plans due to
 33    a restriction present in Section 1917(b)(1)(C) of the Social Security Act  (49
 34    Stat.  620,  42 U.S.C. 1396p(b)(1)(C)) which has discouraged additional states
 35    from enacting long-term care partnership programs by effectively removing  the
 36    major incentive for individuals to participate.
 37        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 38    sion of the Fifty-seventh Idaho Legislature, the House of Representatives  and
 39    the  Senate  concurring  therein,  that  we urge the United States Congress to
 40    amend Section 1917(b)(1)(C) of the Social  Security  Act  (49  Stat.  620,  42
 41    U.S.C.  1396p(b)(1)(C)) by deleting May 14, 1993, as the deadline for approval
 42    by states of long-term care partnership plans, thus affording states  through-
 43    out  the nation the ability to give their citizens the same rights to partici-
 44    pate in those types of plans.

  1        BE IT FURTHER RESOLVED that the Chief Clerk of the  House  of  Representa-
  2    tives  be, and she is hereby authorized and directed to forward a copy of this
  3    Memorial to the President of the Senate and the Speaker of the House of Repre-
  4    sentatives of Congress, and  the  congressional  delegation  representing  the
  5    State of Idaho in the Congress of the United States.

                       STATEMENT OF PURPOSE

The purpose of this memorial is to encourage the US Congress to
amend Section 1917(b) (1) (C) of the Social Security Act by
deleting May 14, 1993 as the deadline for approval by states of
long-term care partnership plans. This will allow all states the
right to participate in long-term care partnership plans.
