  1                                        AN ACT
  2    RELATING TO FISH AND GAME; AMENDING SECTION 36-2204, IDAHO  CODE,  TO  PROVIDE
  3        THAT  THE  IDAHO FISH AND GAME COMMISSION MAY SPECIFY SIGNAGE REQUIREMENTS
  4        FOR SHOOTING PRESERVE BOUNDARIES BY RULE; AND  AMENDING  SECTION  36-2205,
  5        IDAHO  CODE,  TO  PROVIDE THAT THE COMMISSION MAY SPECIFY MARKING REQUIRE-
  6        MENTS FOR ARTIFICIALLY PROPAGATED UPLAND GAME BIRDS RELEASED  ON  SHOOTING
  7        PRESERVES BY RULE.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Section 36-2204, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        36-2204.  BOUNDARIES. The exterior boundaries of  such  shooting  preserve
 12    shall  be clearly defined and posted with appropriate signs erected around the
 13    perimeter at intervals of one hundred fifty (150) feet  or  less  if  unfenced
 14    unless specified otherwise by commission rule. If the boundary of the shooting
 15    preserve  is  fenced,  such signs must be posted at intervals of not more than
 16    five hundred (500) feet unless specified otherwise by commission rule.
                                                                        
 17        SECTION 2.  That Section 36-2205, Idaho Code, be, and the same  is  hereby
 18    amended to read as follows:
                                                                        
 19        36-2205.  GAME BIRDS. (a) Game which may be hunted under this act shall be
 20    confined to artificially propagated upland game birds.
 21        (b)  A minimum release of two hundred (200) upland game birds of each spe-
 22    cies  to be hunted on each shooting preserve must be made on the licensed area
 23    during the shooting preserve season.
 24        (c)  Artificially propagated upland game birds released on a shooting pre-
 25    serve must be:
 26        (1)  Marked by clipping the terminal joint of a single toe on either  foot
 27        as evidenced by a healed scar; or
 28        (2)  Banded  with  a  leg band of a type not removable without breaking or
 29        mutilating, such tag to be supplied by the fish  and  game  department  at
 30        cost.  One  (1) such band shall be securely affixed to one (1) leg of each
 31        bird released and shall remain affixed on the bird until the bird is  pre-
 32        pared for consumption; or
 33        (3)  Marked in a manner specified by commission rule.
 34        (d)  Any  wild  upland  game  bird incidentally taken upon a shooting pre-
 35    serve, at any time other than the general open season therefor, must be marked
 36    then and there with a tag that has been issued to the shooting preserve licen-
 37    see by the Idaho fish and game department. Said bird shall count  as  part  of
 38    the  permittee's  shooting  preserve  limit. The fee for such tags shall be as
 39    specified in section 36-416, Idaho Code, per bird.
 40        During the general hunting season for the taking of upland game birds, all
 41    wild birds harvested on shooting preserves will be subject to the laws  appli-

  1    cable to such wild birds and related rules and proclamations of the Idaho fish
  2    and game commission.

Statement of Purpose / Fiscal Impact


                     STATEMENT  OF  PURPOSE
                            RS 13535
This bill would authorize the Idaho Fish and Game Commission to
specify signing requirements for shooting preserves by
administrative rule. The Commission and Department have been
contacted by several shooting preserve operators who would like to
discuss different methods of signing. However, the Commission and
Department are unable to address these requests because the
required signing is set by statute. This bill would allow the
Commission to address the concerns of the shooting preserve
operators. If the Commission does not adopt new signing
requirements by rule, then the requirements set by statute will
remain in effect.  This bill also proposes that the Idaho Fish and
Game Commission be authorized to adopt by rule additional methods
for the marking of artificially propagated upland game birds for
use at licensed shooting preserves. The statute currently specifies
two alternative methods for the marking of such birds. Several
shooting preserve operators have contacted the Commission and
Department concerning additional alternative marking methods for
birds to be released at their licensed facilities. This bill will
authorize the Commission to adopt additional acceptable bird
marking methods by rule.
