  1                                        AN ACT
  2    RELATING TO THE IDAHO LAW ENFORCEMENT AND FIREFIGHTING MEDAL OF HONOR;  AMEND-
  3        ING  TITLE  67, IDAHO CODE, BY THE ADDITION OF A NEW CHAPTER 88, TITLE 67,
  4        IDAHO CODE, TO ESTABLISH THE IDAHO LAW ENFORCEMENT AND FIREFIGHTING  MEDAL
  5        OF  HONOR,  TO PROVIDE FOR THE CREATION OF A COMMISSION, TO SET FORTH MEM-
  6        BERSHIP, TO PROVIDE FOR COMMISSION POSITIONS, TO REQUIRE COMMISSION  MEET-
  7        INGS,  TO AUTHORIZE THE PROMULGATION OF RULES, TO PROVIDE FOR THE AWARDING
  8        OF THE MEDAL OF HONOR, TO PROVIDE FOR POSTHUMOUS AWARDS, TO SET FORTH  THE
  9        DESIGN  OF  THE MEDAL, TO PROVIDE FOR THE PAYMENT OF THE COST OF THE MEDAL
 10        AND TO PROVIDE THAT THE FAMILY OF A RECIPIENT MAY REQUEST A SECOND MEDAL.
                                                                        
 11    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 12        SECTION 1.  That Title 67, Idaho Code, be, and the same is hereby  amended
 13    by  the addition thereto of a NEW CHAPTER, to be known and designated as Chap-
 14    ter 88, Title 67, Idaho Code, and to read as follows:
                                                                        
 15                                      CHAPTER 88
 16                IDAHO LAW ENFORCEMENT AND FIREFIGHTING MEDAL OF HONOR
                                                                        
 17        67-8801.  IDAHO LAW ENFORCEMENT AND FIREFIGHTING  MEDAL  OF  HONOR  ESTAB-
 18    LISHED.  There is hereby established a decoration of the Idaho law enforcement
 19    and firefighting medal of honor with accompanying  ribbons  and  appurtenances
 20    for  award  by  the  governor  in the name of the state to any law enforcement
 21    officer or firefighter who has been killed or seriously injured in the perfor-
 22    mance of duty, or who has been distinguished by exceptionally meritorious con-
 23    duct, upon nomination of the Idaho law enforcement and firefighting  medal  of
 24    honor commission.
                                                                        
 25        67-8802.  IDAHO LAW ENFORCEMENT AND FIREFIGHTING MEDAL OF HONOR COMMISSION
 26    CREATED  -- MEMBERSHIP -- ESTABLISHMENT OF QUALIFICATIONS FOR AWARD. (1) There
 27    is hereby created in the office of the governor the Idaho law enforcement  and
 28    firefighting  medal  of honor commission, hereafter referred to as the commis-
 29    sion, which shall nominate candidates for the award of the Idaho law  enforce-
 30    ment  and firefighting medal of honor. The commission shall consist of one (1)
 31    representative from each of the following: the office  of  the  governor,  the
 32    office  of  the attorney general, the Idaho prosecuting attorneys association,
 33    the Idaho chiefs of police association, the Idaho fire chiefs association, the
 34    Idaho sheriffs' association, the Idaho  peace  officers  association  and  the
 35    peace officers standards and training council. Members of the commission shall
 36    be  appointed  by  the  governor  and  shall each serve for a term of four (4)
 37    years.
 38        (2)  The attorney general or his designee shall serve as chair of the com-
 39    mission and shall designate a secretary for the commission.
 40        (3)  The commission shall meet annually, or at the call of the  chair,  to
 41    consider  candidates  for nomination. Commission meetings may be conducted via

  1    teleconference.
  2        (4)  The commission shall adopt rules establishing the qualifications  for
  3    the  Idaho  law  enforcement  and firefighting medal of honor and the protocol
  4    governing the decoration, and other rules necessary to carry out the  purposes
  5    of this chapter.
                                                                        
  6        67-8803.  WHEN  AND  BY  WHOM AWARDED. The Idaho law enforcement and fire-
  7    fighting medal of honor shall be awarded by the  governor  to  the  recipients
  8    during  the  national law enforcement recognition week. The governor may dele-
  9    gate the awarding of the medal to the lieutenant governor or the attorney gen-
 10    eral.
                                                                        
 11        67-8804.  POSTHUMOUS AWARD. The Idaho  law  enforcement  and  firefighting
 12    medal of honor may be awarded posthumously by presentation to a representative
 13    of  the deceased as may be deemed appropriate by the governor or the designees
 14    specified in section 67-8803, Idaho Code.
                                                                        
 15        67-8805.  DESIGN AND COST. The decoration of the Idaho law enforcement and
 16    firefighting medal of honor shall be cast in bronze or other metal. The design
 17    of the medal shall incorporate the great seal of the state of Idaho with other
 18    insignia as deemed appropriate by the law enforcement and  firefighting  medal
 19    of honor commission. The reverse of the decoration shall be inscribed with the
 20    words: "For exceptionally honorable and meritorious conduct in performing ser-
 21    vices  as  a  law  enforcement  officer or firefighter." The cost of the medal
 22    shall be paid by the agency whose officer or firefighter receives  the  medal.
 23    The  family  of  a  recipient  may request a second medal and may receive such
 24    medal upon payment to the commission of the cost of the medal.

                       STATEMENT OF PURPOSE

This legislation will result in statewide recognition for
extraordinary acts of valor and heroism by firefighters and
police.  There is presently no statewide award for this purpose. 
This legislation establishes a Commission to consider nominations
for the "Idaho Law Enforcement and Firefighting Medal of Honor,"
and directs that the medals are presented by the Governor at an
annual ceremony.  This award may be given posthumously.  This
award is an appropriate means of recognizing that Idaho's
firefighters and police every day face the possibility of serious
injury or death in the performance of their duties, and assures
that their sacrifices are recognized, and their bravery honored,
by the state whose citizens they  protect.


                                
                                
                         FISCAL IMPACT
                                
                                
This legislation will not require the commitment of state money. 
The annual meeting of  the Commission established to consider
nominations may be held in Boise (where most of the Commission
members would work and/or reside) or via teleconference,
eliminating travel costs. The cost of the medal itself is ninety
dollars ($90.00).  This cost will not be borne by the state, but
by the agency whose officer or firefighter is honored with the
award.  Should families of honorees wish to have more than one
medal, they will be asked to bear any costs for the additional
