  1                                        AN ACT
  2    RELATING TO STUDENTS CALLED TO ACTIVE DUTY; AMENDING  SECTION  33-3719,  IDAHO
  3        CODE,  TO  EXTEND  RIGHTS OF STUDENTS CALLED TO ACTIVE DUTY TO INDIVIDUALS
  4        CALLED UNDER CONDITIONS SPECIFIED; AND DECLARING AN EMERGENCY.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 33-3719, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        33-3719.  STUDENT CALLED TO ACTIVE DUTY. Whenever any active member of the
  9    Idaho national guard is called or ordered by the governor to state active duty
 10    for  thirty  (30) consecutive days or more, or to duty other than for training
 11    pursuant to title 32, U.S.C.,  or  called  or  ordered  by  competent  federal
 12    authority  into  active  federal  service under title 10 U.S.C. for duty other
 13    than for training for thirty (30) consecutive days  or  more,  an  educational
 14    institution in this state in which the member is enrolled shall grant the mem-
 15    ber  military  leave  of  absence  from his education. Individuals on military
 16    leave of absence from their educational institution, upon release  from  mili-
 17    tary duty, shall be restored to the educational status they had attained prior
 18    to  their  being  ordered  to  military  duty without loss of academic credits
 19    earned, scholarships or grants awarded, or tuition and other fees  paid  prior
 20    to  the  commencement of the military duty. It shall be the duty of the educa-
 21    tional institution to refund tuition or fees or to credit the tuition,  schol-
 22    arships,  grants and fees to the next academic semester or term after the ter-
 23    mination of the educational military leave of absence at  the  option  of  the
 24    student.
                                                                        
 25        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 26    declared to exist, this act shall be in full force and effect on and after its
 27    passage and approval.

                      STATEMENT OF PURPOSE
                            RS 13820

This proposal amends section I.C.  33-3719 by extending the
education protections of the Militia Civil Relief Act to National
Guard members who are ordered to federal active service under
Title 10, United States Code, for duty other than for training
lasting 30 days or more.

There is no fiscal impact from this proposal.
