]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE SENATE SENATE BILL NO. 1278 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO THE DEPARTMENT OF ENVIRONMENTAL QUALITY; AMENDING SECTION 39-3626, 3 IDAHO CODE, TO PROVIDE THAT THE DEPARTMENT MAY USE A LIMITED PORTION OF 4 INTEREST REVENUES FROM WASTEWATER AND DRINKING WATER LOANS FOR OPERATION 5 OF THE LOAN PROGRAMS SUBJECT TO ANNUAL APPROPRIATION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 39-3626, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 39-3626. AUTHORIZATION OF GRANTS AND LOANS -- DESIGNATION OF ADMINISTER- 10 ING AGENCY -- RESERVATION OF FUNDS FOR OPERATIONS -- CRITERIA -- PRIORITY 11 PROJECTS -- ELIGIBLE PROJECTS. (1) The state of Idaho is hereby authorized to 12 make grants and loans at or below market interest rates, as funds are avail- 13 able, to any municipality to assist said municipality in the construction of 14 sewage treatment works, to community public water systems and nonprofit 15 noncommunity public water systems. The state of Idaho is hereby also autho- 16 rized to make loans at or below market interest rates for the implementation 17 of a management program established under section 319 of the federal water 18 pollution control act, as amended. 19 (2) The department of environmental quality may use a portion of the 20 interest revenues from wastewater and drinking water loans, in an amount not 21 to exceed one percent (1%) of loans outstanding, subject to annual appropria- 22 tion, for operation of the wastewater and drinking water loan programs. 23 (3) The Idaho board of environmental quality through the department of 24 environmental quality shall be the agency for administration of funds autho- 25 rized for grants or loans under this chapter, and may reserve up to four per- 26 cent (4%) of the moneys accruing annually to the water pollution control and 27 wastewater facility loan funds to be appropriated annually for the purpose of 28 operating the water quality programs established pursuant to this chapter. The 29 board may also reserve up to six percent (6%) of the moneys accruing annually 30 to the water pollution control fund to be appropriated annually for the pur- 31 pose of conducting water quality studies including monitoring. 32 (34) In allocating state construction grants and loans under this chap- 33 ter, the Idaho board of environmental quality shall give consideration to 34 water pollution control needs, protection of public health and provision of 35 safe drinking water. 36 (45) Pursuant to subsection (34) of this section, the Idaho board of 37 environmental quality shall establish an integrated list of priority municipal 38 sewage facility and nonpoint source pollution control projects and a list of 39 priority community and nonprofit noncommunity public water systems.
STATEMENT OF PURPOSE RS 13677 The proposed legislation allows the Department of Environmental Quality (DEQ) to use a portion of the interest revenues from wastewater (CWSRF) and drinking water (DWSRF) loans for operating the programs. Currently, the programs are funded by 4% of the annual federal contributions (approximately $13.8 million per year). This level of federal contribution is expected to decrease and will not provide sufficient resources for DEQ to manage the programs as the total funds managed have increased to over $150 million. This funding mechanism will allow the programs to be self supporting. FISCAL IMPACT There is no fiscal impact to the general fund. A reduction in the SRF funds available for future loans would be in the amount of the funds used to administer the program. DEQ envisions no increased cost to borrowers.
