1 AN ACT
2 RELATING TO ESTABLISHING SALARIES; AMENDING SECTION 67-5309B, IDAHO CODE, TO
3 PROVIDE THAT THE FIRST ONE PERCENT OF ANY INCREASE IN SALARIES FOR STATE
4 EMPLOYEES SHALL BE AWARDED TO ALL EMPLOYEES REGARDLESS OF MERIT; AND
5 DECLARING AN EMERGENCY.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 67-5309B, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 67-5309B. ESTABLISHING SALARIES. (a) The administrator of the division of
10 human resources shall determine the relative worth of each job classification
11 established pursuant to section 67-5309, Idaho Code, and, in making such
12 determination, shall utilize the guide chart profile method and correlated
13 factoring benchmark job classifications developed by Hay management consul-
14 tants, to ensure internal equity within the classified service.
15 (b) Job classifications established or revised by the administrator shall
16 be assigned by the administrator to a pay grade subject to the approval of the
17 administrator of the division of financial management, based on funding con-
18 siderations.
19 (c) The administrator shall conduct or approve salary surveys within rel-
20 evant labor markets to determine salary ranges that represent competitive
21 labor market average rates paid by private industry and other governmental
22 units for jobs of like value, based upon the guide chart profile system
23 described in subsection (a) of this section. The results of such surveys shall
24 be based on statistical, historical, or other economic factors. The factors
25 herein referred to shall include, but are not limited to, anticipated salary
26 adjustments for the positions surveyed, changes in cost-of-living as measured
27 by the consumer price index, and anticipated adjustments in the average weekly
28 wage in the state of Idaho, as defined and determined pursuant to section
29 72-409, Idaho Code.
30 (d) A report of the results of salary surveys and recommendations for
31 changes in salaries, together with their estimated costs of implementation
32 based on the competitive labor market average rate of each pay grade, as
33 approved by the administrator, shall be submitted to the governor not later
34 than the first day of October of each year. If the governor accepts the
35 administrator's report, he shall submit it to the legislature prior to the
36 seventh legislative day of each session. If the governor does not accept the
37 report of the administrator, he shall submit his own report on proposed
38 changes in salaries, and the administrator's report, to the legislature prior
39 to the seventh legislative day of each session. The legislature may, by con-
40 current resolution, accept, modify or reject either report. The failure of the
41 legislature to accept, modify or reject either report prior to adjournment
42 sine die shall constitute approval of the governor's report. The administrator
43 shall implement the results of such salary changes by rule, using the payline

1 formulas approved by the legislature and the mid-point of each pay grade
2 established in section 67-5309C, Idaho Code. Notwithstanding any other provi-
3 sion of law to the contrary, the first one percent (1%) of any increase in
4 salaries for state employees shall be awarded to all employees regardless of
5 merit.
6 SECTION 2. An emergency existing therefor, which emergency is hereby
7 declared to exist, this act shall be in full force and effect on and after its
8 passage and approval.

any pay increase for State Employees will be distributed across the
board.
