]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE SENATE SENATE BILL NO. 1354 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO THE STATE BOARD OF EDUCATION; AMENDING SECTION 33-102, IDAHO CODE, 3 TO PROVIDE ADDITIONAL QUALIFICATIONS FOR MEMBERS OF THE STATE BOARD OF 4 EDUCATION. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 33-102, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 33-102. MEMBERSHIP -- APPOINTMENT -- TERM OF OFFICE -- QUALIFICATIONS -- 9 PLACE OF OFFICE. The state board of education shall consist of the state 10 superintendent of public instruction, who shall be an ex officio voting member 11 and who shall serve as executive secretary of the board for all elementary and 12 secondary school matters, and seven (7) members appointed by the governor, 13 each for a term of five (5) years. Annually on the first day of March the gov- 14 ernor shall appoint members to fill the board positions for which the terms of 15 office have expired. The governor shall, by appointment, fill any vacancy on 16 the board, such appointment to be for the unexpired term of the retiring mem- 17 ber. Appointment to the board shall be madesolelyupon consideration of the 18 ability of such appointees to efficientlytoserve the interests of the 19 people,and of education, without reference to locality, occupation, party20affiliation or religion. Consideration shall be given to balanced geographical 21 representation, and at least three (3) but not more than four (4) of the mem- 22 bers shall be from the same major political party. Any person appointed to 23 said board shall have been a resident of the state for not less than three (3) 24 years prior to the date of appointment; and shall qualify and assume the 25 duties in accordance with laws governing similar appointments to, and qualifi- 26 cations for, office on other state boards. All appointments of members to the 27 state board of education made after the effective date of this act must be 28 confirmed by the senate. 29 Members of the state board of education holding office on the effective 30 date of this act shall continue in office for the balance of the term to which 31 they were appointed. 32 The state board shall have and maintain its office in Ada county.

NO. 1354 1 AMENDMENT TO THE BILL 2 On page 1, following line 32, insert: 3 "SECTION 2. All members of the State Board of Education serving on the 4 effective date of this act shall be entitled to complete the current term of 5 office. Beginning with the first vacancy to occur and continuing until the 6 terms of this act are fully implemented, appointments shall be made to move 7 towards compliance and then to maintain compliance with the provisions of this 8 act.". 9 CORRECTION TO TITLE 10 On page 1, in line 4, following "EDUCATION" insert: "; AND PROVIDING FOR 11 TRANSITION".

STATEMENT OF PURPOSE RS13911C1 The purpose of the legislation is to change Idaho Code dealing with appointment to the State Board of Education. The intent is to better assure that the interests of the people, and of education, are served. FISCAL IMPACT There is no fiscal impact.
