1 AN ACT
2 RELATING TO CHARTER SCHOOLS; AMENDING CHAPTER 52, TITLE 33, IDAHO CODE, BY THE
3 ADDITION OF A NEW SECTION 33-5202A, IDAHO CODE, TO PROHIBIT CREATION OF
4 ADDITIONAL EXCLUSIVELY VIRTUAL DISTANCE LEARNING CHARTER SCHOOLS; AND
5 DECLARING AN EMERGENCY.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Chapter 52, Title 33, Idaho Code, be, and the same is
8 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
9 ignated as Section 33-5202A, Idaho Code, and to read as follows:
10 33-5202A. EXCLUSIVELY VIRTUAL DISTANCE LEARNING CHARTER SCHOOL. No
11 charter school shall be created after the effective date of this section which
12 is exclusively a virtual distance learning school. Each charter school shall
13 require a physical facility where the students are in attendance for the
14 delivery of the educational program. A virtual school created prior to the
15 effective date of this section shall be authorized to continue to operate
16 without reference to the provisions of this section.
17 SECTION 2. An emergency existing therefor, which emergency is hereby
18 declared to exist, this act shall be in full force and effect on and after its
19 passage and approval.
