APPROPRIATIONS - TRANSPORTATION DEPARTMENT - Appropriates $425,910,300 to
the Idaho Transportation Department for fiscal year 2005; limits the number
of full-time equivalent positions to 1,833.5; provides legislative intent
that all moneys transferred to the Local Bridge Inspection Fund and
Railroad Grade Crossing Protection Fund be continuously appropriated;
authorizes a transfer of funds to the Aeronautics Fund; reappropriates
certain unexpended and unencumbered balances for the Contract Construction
and Right-of-Way Acquisition Program; reappropriates certain unexpended and
unencumbered balances of the restricted disaster State Highway Fund to the
Idaho Transportation Department; reappropriates certain unexpended and
unencumbered balances for Airport Development Grants; authorizes the
transfer of moneys to the Tourism and Promotion Fund in the Department of
Commerce for matching fund support of the Gateway Visitor Centers; and
recognizes the Idaho Department of Transportation's practice of

2 APPROPRIATING MONEYS TO THE IDAHO TRANSPORTATION DEPARTMENT FOR FISCAL YEAR
3 2005; LIMITING THE NUMBER OF AUTHORIZED FULL-TIME EQUIVALENT POSITIONS;
4 EXPRESSING LEGISLATIVE INTENT WITH REGARD TO CERTAIN TRANSFERS BEING CON-
5 TINUOUSLY APPROPRIATED; AUTHORIZING THE TRANSFER OF HIGHWAY FUNDS TO THE
6 AERONAUTICS FUND; REAPPROPRIATING CERTAIN UNEXPENDED AND UNENCUMBERED BAL-
7 ANCES FOR CONTRACT CONSTRUCTION AND RIGHT-OF-WAY ACQUISITION; REAPPROPRIA-
8 TING CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES OF THE RESTRICTED DISAS-
9 TER STATE HIGHWAY FUND; REAPPROPRIATING CERTAIN UNEXPENDED AND UNENCUM-

11 HIGHWAY FUNDS TO THE TOURISM AND PROMOTION FUND; AND RECOGNIZING THE IDAHO

14 Be It Enacted by the Legislature of the State of Idaho:
15 SECTION 1. There is hereby appropriated to the Idaho Transportation
16 Department the following amounts to be expended for the designated programs
17 according to the designated expense classes from the listed funds for the
18 period July 1, 2004, through June 30, 2005:

28 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Idaho
29 Transportation Department is authorized no more than one thousand eight hun-
30 dred thirty-three and five-tenths (1,833.5) full-time equivalent positions at
31 any point during the period July 1, 2004, through June 30, 2005, for the pro-
32 grams specified in Section 1 of this act, unless specifically authorized by
33 the Governor. The Joint Finance-Appropriations Committee will be notified
34 promptly of any increased positions so authorized.
35 SECTION 3. It is legislative intent that all moneys transferred to the
36 Local Bridge Inspection Fund and to the Railroad Grade Crossing Protection
37 Fund, as provided in Section 63-2412, Idaho Code, are hereby continuously
38 appropriated to the Idaho Transportation Department for the stated purposes of
39 those funds.
40 SECTION 4. The Idaho Transportation Department is authorized to transfer
41 up to $71,300 from the State Highway Fund to the State Aeronautics Fund during
42 the fiscal year. It is legislative intent that the moneys transferred be used
43 to offset operating costs of the Aircraft Pool Program or be used to establish
44 a reserve for capital replacement costs of the Aircraft Pool Program.
45 SECTION 5. There is hereby reappropriated to the Idaho Transportation
46 Department any unexpended and unencumbered balances of the State Highway Fund
47 appropriated for the Contract Construction and Right-of-Way Acquisition Pro-
48 gram for fiscal year 2004, to be used for Contract Construction and Right-of-
49 Way Acquisition only for the period July 1, 2004, through June 30, 2005.

1 SECTION 6. All unexpended and unencumbered moneys previously appropriated
2 to the Idaho Transportation Department from funds deposited to the restricted
3 disaster State Highway Fund are hereby reappropriated to the Idaho Transporta-
4 tion Department for the period July 1, 2004, through June 30, 2005.
5 SECTION 7. There is hereby reappropriated to the Idaho Transportation
6 Department any unexpended and unencumbered balances of the State Aeronautics
7 Fund appropriated for trustee and benefit payments for fiscal year 2004, to be
8 used for Airport Development Grants for the period July 1, 2004, through June
9 30, 2005.
10 SECTION 8. There is hereby appropriated and the State Controller is
11 directed to transfer $25,000 from the State Highway Fund to the Tourism and
12 Promotion Fund in the Department of Commerce during fiscal year 2005. This
13 transfer will provide the matching fund support of the Gateway Visitor Cen-
14 ters.
15 SECTION 9. The Legislature recognizes the Idaho Transportation
16 Department's practice of transferring year-end remainders of eligible spending
17 authority, when supported by actual revenue collections, to the Contract Con-
18 struction and Right-of-Way Acquisition budget unit for use on construction
19 projects. The Legislature joins with the Department in making this commitment
20 to Idaho's roads and citizens.
