1 AN ACT
2 APPROPRIATING MONEYS TO THE DEPARTMENT OF ADMINISTRATION FOR THE IDAHO STATE
3 CAPITOL COMMISSION FOR FISCAL YEAR 2005; APPROPRIATING ADDITIONAL MONEYS
4 TO THE DEPARTMENT OF ADMINISTRATION FOR THE IDAHO STATE CAPITOL COMMIS-
5 SION; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; REAPPROPRIA-
6 TING CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES; DIRECTING TRANSFER OF
7 MONEYS; AND DECLARING AN EMERGENCY FOR SECTIONS 2 AND 5 OF THIS ACT.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. There is hereby appropriated to the Department of Administra-
10 tion for the Idaho State Capitol Commission the following amounts to be
11 expended according to the designated expense classes from the listed fund for
12 the period July 1, 2004, through June 30, 2005:

16 Operating Expenditures 97,300
17 TOTAL $128,900

19 Capitol Endowment Income Fund $128,900
20 SECTION 2. In addition to the appropriation made in Section 1, Chapter
21 319, Laws of 2003, and in Section 1 of this act, there is hereby appropriated
22 to the Department of Administration for the Idaho State Capitol Commission the
23 following amount to be expended according to the designated expense class from
24 the listed fund for the period March 1, 2004, through June 30, 2005.

27 Capital Outlay $2,006,900

29 Capital Endowment Income Fund $2,006,900
30 SECTION 3. In accordance with Section 67-3519, Idaho Code, the Idaho
31 State Capitol Commission is authorized no more than one-tenth (0.1) full-time
32 equivalent position at any point during the period July 1, 2004, through June
33 30, 2005, for the program specified in Section 1 of this act, unless specifi-
34 cally authorized by the Governor. The Joint Finance-Appropriations Committee
35 will be notified promptly of any increased positions so authorized.
36 SECTION 4. There is hereby reappropriated to the Department of Adminis-
37 tration for the Idaho State Capitol Commission the unexpended and unencumbered
38 balance of any funds appropriated by Section 1, Chapter 319, Laws of 2003, to
39 be used for nonrecurring expenditures only for the period July 1, 2004,
40 through June 30, 2005.

1 SECTION 5. The State Controller is hereby directed to transfer on the
2 effective date of this act, or as soon thereafter as is practicable,
3 $2,750,000 from the Capitol Endowment Income Fund to the Capitol Permanent
4 Endowment Fund.
5 SECTION 6. An emergency existing therefor, which emergency is hereby
6 declared to exist, Sections 2 and 5 of this act shall be in full force and
7 effect on and after passage and approval.

This is the fiscal year 2005 appropriation for the Capitol Commission in the amount of $2,135,800. The Commission is funded entirely with dedicated funds. This bill includes spending authority for two enhancements to fund repairs to the exterior of the Capitol Building.
