  1                                        AN ACT
  2    RELATING TO ANIMAL DISEASE CONTROL; AMENDING SECTION 25-207A, IDAHO  CODE,  TO
  3        PROVIDE  THAT  THE  DEPARTMENT  OF  FISH AND GAME SHALL COOPERATE WITH THE
  4        DIVISION OF ANIMAL INDUSTRIES REGARDING SPACIAL SEPARATION OF BIG GAME AND
  5        LIVESTOCK IN CERTAIN AREAS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 25-207A, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        25-207A.  PRIVATE  FEEDING  OF  BIG GAME ANIMALS -- RULES FOR DISEASE CON-
 10    TROL. (1) In order to provide for disease control and the protection of health
 11    and human safety, the division of animal industries is authorized  to  promul-
 12    gate  rules  for  the regulation and prohibition of the private feeding of big
 13    game animals.
 14        (2)  The division shall cooperate with the department of fish and game  in
 15    the  designation  of  such  areas  and  the promulgation of rules necessary to
 16    facilitate such regulation.
 17        (3)  The Idaho department of fish and game shall cooperate with the  divi-
 18    sion  regarding spacial separation of big game and livestock in any areas des-
 19    ignated by the division as requiring disease control methods.
 20        (4)  Rulemaking authority pursuant to the provisions of this section shall
 21    only apply to regulate or prohibit persons who purposely or knowingly  provide
 22    supplemental  feed  to big game animals in a manner that results in an artifi-
 23    cial concentration of such animals that  may  potentially  contribute  to  the
 24    transmission of disease.
 25        (45)  Rulemaking  authority  pursuant  to  the  provisions of this section
 26    shall not apply to supplemental feeding activities conducted by the department
 27    of fish and game.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 14198

The purpose of this legislation is to allow the Idaho State
Department of Agriculture and the Idaho Department of Fish and
Game to work cooperatively to control the spread of brucellosis
in Eastern Idaho.
