                            SENATE CONCURRENT RESOLUTION NO. 124

  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF  THE  DIVI-
  3        SION OF HUMAN RESOURCES AND PERSONNEL COMMISSION.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is  the finding of the Legislature that certain rules of the
 10    Division of Human Resources and Personnel Commission are not  consistent  with
 11    legislative intent and should be rejected.
 12        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 13    sion of the Fifty-seventh Idaho Legislature, the Senate and the House of  Rep-
 14    resentatives concurring therein, that IDAPA 15.04.01, rules of the Division of
 15    Human  Resources  and  Personnel  Commission,  the  entire  rulemaking docket,
 16    adopted as pending rules under Docket Number 15-0401-0301, be,  and  the  same
 17    are hereby rejected and declared null, void and of no force and effect.

                      STATEMENT OF PURPOSE

This concurrent resolution would reject the entire pending rules
docket of the  Division of Human Resources and Personnel
Commission.  The effect of this resolution, if adopted by both
houses, would be to prevent the agency rules from going into
effect.

This concurrent resolution has no fiscal impact
