                            SENATE CONCURRENT RESOLUTION NO. 128
                                                                        
                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART-
  3        MENT OF AGRICULTURE RELATING TO TUBERCULOSIS AND THE  PRIVATE  FEEDING  OF
  4        BIG GAME ANIMALS.
                                                                        
  5    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  6        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  7    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  8    that the Legislature finds that the rules are not consistent with  legislative
  9    intent; and
 10        WHEREAS,  it  is  the finding of the Legislature that certain rules of the
 11    Department of Agriculture relating to tuberculosis and the private feeding  of
 12    big  game  animals  are  not  consistent with legislative intent and should be
 13    rejected.
 14        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 15    sion  of the Fifty-seventh Idaho Legislature, the Senate and the House of Rep-
 16    resentatives concurring therein, that IDAPA 02.04.24, Section 022,  Subsection
 17    02,  rules of the Department of Agriculture governing tuberculosis and inspec-
 18    tions, adopted as a pending rule under Docket Number 02-0424-0301,  and  IDAPA
 19    02.04.25, rules of the Department of Agriculture governing the private feeding
 20    of  big  game animals, the entire rulemaking docket, adopted as a pending rule
 21    under Docket Number 02-0425-0301, be, and the same  are  hereby  rejected  and
 22    declared null, void and of no force and effect.

                      STATEMENT OF PURPOSE

This concurrent resolution would reject certain pending rules of
the  department of agriculture relating to tuberculosis and the
private feeding of big game animals.  The effect of this
resolution, if adopted by both houses, would be to prevent the
agency rules from going into effect.
