SENATE CONCURRENT RESOLUTION NO. 132

1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
3 APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF PUBLIC TRANSPOR-
4 TATION AND RELATED AIR QUALITY ISSUES IN IDAHO.
5 Be It Resolved by the Legislature of the State of Idaho:
6 WHEREAS, public transportation currently is a significant component of
7 Idaho's transportation system in both urban and rural areas; and
8 WHEREAS, six metropolitan areas in Idaho were designated urbanized by the
9 U.S. Census Bureau following the 2000 Census, making them eligible for federal
10 transit funds; and
11 WHEREAS, substantial population growth in several of these metropolitan
12 areas has resulted in an increase in the use of motor vehicles in such areas
13 so that the air quality in such areas may be deteriorating, including deterio-
14 ration resulting in the potential for the federal government to designate such
15 areas as nonattainment areas pursuant to the federal Clean Air Act; and
16 WHEREAS, nonattainment designation could result in a substantial reduction
17 in federal transportation funds as well as significantly reducing economic
18 development opportunities in areas so designated; and
19 WHEREAS, public transportation necessarily will play a more significant
20 role in the future because it can significantly alleviate congestion on road-
21 ways, providing for more efficient use of energy, extending the useful life of
22 roadways, and reducing air quality problems associated with an increase in the
23 number of private vehicles traveling on roadways; and
24 WHEREAS, existing public transportation systems within the state may not
25 be adequate to meet existing and future demand; and
26 WHEREAS, there is a need to analyze both the wide variety of methods to
27 coordinate and enhance public transportation as well as the methods to protect
28 and enhance air quality in various regions of the state; and
29 WHEREAS, there is a need to examine the various federal programs and
30 related funding sources designed to support public transportation as well as
31 to protect and enhance air quality; and
32 WHEREAS, the Second Regular Session of the Fifty-seventh Idaho Legislature
33 considered legislation to require motor vehicle emissions control programs in
34 densely-populated counties where emissions from all sources, including vehi-
35 cles, threaten to exceed ambient air quality standards; and
36 WHEREAS, the Idaho Task Force on Public Transportation provided to the
37 Second Regular Session of the Fifty-seventh Idaho Legislature a comprehensive
38 report that:
39 (1) Documents private and all public, federal, state and local funds
40 expended on public transportation in Idaho; and
41 (2) Documents an inventory of existing public transportation services;
42 and
43 (3) Recommends strategies for methods to coordinate public transportation
44 services; and

1 (4) Recommends strategies for providing private and public funding of
2 public transportation services; and
3 WHEREAS, there is a need for the Legislature to further study and analyze
4 these issues during the interim between sessions of the Legislature.
5 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
6 sion of the Fifty-seventh Idaho Legislature, the Senate and the House of Rep-
7 resentatives concurring therein, that the Legislative Council is authorized to
8 appoint a committee to undertake and complete a study of public transportation
9 and related air quality issues. The Legislative Council shall determine the
10 number of legislators and membership from each house appointed to the commit-
11 tee and shall authorize the committee to receive input, advice and assistance
12 from interested and affected parties who are not members of the legislature.
13 BE IT FURTHER RESOLVED that the committee will:
14 (1) Review the report of the Idaho Task Force on Public Transportation;
15 (2) Identify transportation links such as park and ride, rail, transit,
16 commuter services and air services, within the state of Idaho;
17 (3) Identify overlapping and duplicative public transportation services;
18 (4) Recommend strategies for methods to coordinate public transportation
19 services;
20 (5) Recommend strategies for providing private and public funding of pub-
21 lic transportation services;
22 (6) Recommend strategies for maintaining and enhancing air quality in the
23 regions of the state of Idaho threatened by potential federal Clean Air
24 Act nonattainment designations; and
25 (7) Develop any legislation related to these matters as the committee
26 deems appropriate.
27 BE IT FURTHER RESOLVED that the committee shall request that the Idaho
28 Transportation Department, the Idaho Department of Health and Welfare, the
29 Idaho Department of Environmental Quality, the Idaho Commission on Aging and
30 all other state agencies necessary for completion of the committee's assign-
31 ments assist the committee as requested.
32 BE IT FURTHER RESOLVED that the committee shall request that the Inter-
33 agency Working Group on Public Transportation created in Section 40-514, Idaho
34 Code, be a collaborator with the committee to provide input and advice. The
35 committee will not duplicate the duties or obligations of the Interagency
36 Working Group.
37 BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
38 appointed by the cochairs of the committee who are appointed by the Legisla-
39 tive Council. Nonlegislative members of the advisory committee shall not be
40 reimbursed from legislative funds for per diem, mileage or other expenses and
41 shall not have voting privileges regarding the committee's recommendations or
42 proposed legislation.
43 BE IT FURTHER RESOLVED that the committee shall report its findings, rec-
44 ommendations and proposed legislation, if any, to the First Regular Session of
45 the Fifty-eighth Idaho Legislature.
STATEMENT OF PURPOSE
RS14215
This resolution directs Legislative Council to appoint an interim
committee to analyze public transportation and related air quality
issues. The committee is to deliver a report and any recommended
legislation to the next session of the legislature.
FISCAL NOTE
If this resolution is adopted by the Legislature and the committee
is appointed by Legislative Council, any necessary legislator travel and
per diem expense would be paid from the existing legislative
appropriation to the Senate and the House of Representatives. Funding
for staff support and expenses would be provided from the existing
appropriation to the Legislative Council for the Legislative Services
Office. There would be no additional impact upon the state general fund
as a result of this resolution.
