  1                                 A SENATE RESOLUTION
  2    PROVIDING FOR AN AMENDMENT TO RULE 20 OF THE RULES OF THE SENATE.
                                                                        
  3    Be It Resolved by the Senate of the State of Idaho:
                                                                        
  4        WHEREAS, the Senate deems it necessary and desirable that an amendment  to
  5    the Senate Rule 20 be adopted.
  6        NOW,  THEREFORE, BE IT RESOLVED by the members of the Senate, assembled in
  7    the Second Regular Session of the Fifty-seventh Idaho Legislature, that Senate
  8    Rule 20, be, and the same is hereby amended to read as follows:
                                                                        
  9                                       RULE 20
 10        Committees -- Quorum. -- (A)  Committees shall not proceed to the transac-
 11    tion of business except upon a quorum being present when  the  committee  con-
 12    venes,  nor  thereafter  if any member objects to a lack of a quorum. A quorum
 13    shall consist of a majority of the committee membership.
 14        Committee Meetings. -- (B)  No committee shall meet during the session  of
 15    the  Senate,  nor  at any time occupy the Senate Chamber, without leave of the
 16    Senate.
 17        Committees -- Rules and Procedure.  --  (C)  Unless  otherwise  specified,
 18    general  rules of procedure governing the Senate shall govern procedure in all
 19    committees and subcommittees, except there may be no call of any committee  or
 20    of  the  Senate while in the Committee of the Whole. A motion to adjourn shall
 21    not be in order in the Committee of the Whole.
 22        Committee Hearings. -- (D)  All proceedings of the Senate and the  Commit-
 23    tee of the Whole shall be open. Hearings held by any standing, select, or spe-
 24    cial  committee  shall  be open to the public at all times, and any person may
 25    attend any hearing of such committee, but may  participate  in  the  committee
 26    only with the approval of the committee itself. The committee chairman, or the
 27    acting  chairman,  shall  announce the subject of the matter under inquiry and
 28    proceed with hearing testimony or examining witnesses. Each person  testifying
 29    before  the  committee shall state his name, address, business, or occupation,
 30    and special interest in the matter being heard.
 31        Committee Meetings Attendance. -- (E)  All persons may attend any  meeting
 32    of any standing, select, or special committee, but may participate in deliber-
 33    ations  or  discussions  only with the approval of the committee. Nothing con-
 34    tained in this rule shall be construed to  prevent,  upon  a  two-thirds  vote
 35    recorded  in  the  minutes of the meeting of the committee, the committee from
 36    holding an executive session during any meeting after the chairman has identi-
 37    fied the authorization under the provisions of Section  67-2345,  Idaho  Code,
 38    for  holding  the  executive session. An executive session may be held as pro-
 39    vided in Section 67-2345, Idaho Code.
 40        Hearings Required. -- (F)  No bill shall be sent to the  Senate  floor  by
 41    any committee of the Senate without a public hearing on the bill for testimony
 42    to be presented,  if such bill is proposing to amend the statutes of the state
 43    of Idaho and if a hearing is requested by any committee member.

  1        Objection  to  Testimony.  --  (FG)  If  any member of the committee shall
  2    object to the testimony, or any part thereof, of any witness, the chair of the
  3    committee may overrule the objection, require the witness to refrain from  the
  4    objectionable  testimony or may disallow further testimony and otherwise main-
  5    tain order. The chair of the committee shall decide  all  questions  of  order
  6    subject to appeal.
  7        Buck  Slips.  --  (GH)  Buck slips may be used for committee action on the
  8    introduction of or recommendations on bills, but only in instances where  com-
  9    mittee  meetings  are impractical.  The objection to the use of a buck slip by
 10    one committee member shall preclude its use in that instance.   All  committee
 11    members,  who are not absent and excused from attendance in the Senate on that
 12    day, shall be required to sign their names indicating their aye or nay vote on
 13    the matter being considered.

                       STATEMENT OF PURPOSE

The purpose of this legislation is to amend Senate Rule 20 to
provide that if any committee sends a bill to the floor for
consideration, and if that bill amends any state statute, a
public hearing at which testimony is allowed to be presented
shall have been held on the bill if one or more committee
member(s) so request.
