  1                                        AN ACT
  2    RELATING TO FISCAL MATTERS OF  FIRE  PROTECTION  DISTRICTS;  AMENDING  SECTION
  3        31-1419A, IDAHO CODE, TO PROVIDE THAT THE FISCAL YEAR OF A FIRE PROTECTION
  4        DISTRICT  SHALL COMMENCE EITHER ON THE FIRST DAY OF OCTOBER OF EACH CALEN-
  5        DAR YEAR, OR ON THE FIRST DAY OF JANUARY OF EACH CALENDAR YEAR, AS  ESTAB-
  6        LISHED  BY RESOLUTION OF THE FIRE PROTECTION DISTRICT BOARD OF COMMISSION-
  7        ERS.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Section 31-1419A, Idaho Code, be, and the same is  hereby
 10    amended to read as follows:
                                                                        
 11        31-1419A.  BUDGET  AND  HEARING -- NOTICE OF HEARING -- PUBLIC INSPECTION.
 12    (1) The fire protection district board shall adopt a budget and shall cause  a
 13    public  hearing to be held upon such budget, prior to certifying a tax levy to
 14    the board of county commissioners of each county within the district, or  hav-
 15    ing a portion of its territory within the district.
 16        (2)  Notice  of  the  budget  hearing meeting shall be posted at least ten
 17    (10) full days prior to the date of said meeting in at least one (1) conspicu-
 18    ous place in each fire protection district to be determined by  the  board;  a
 19    copy  of  such  notice  shall also be published in a daily or weekly newspaper
 20    published within such district, in one (1) issue thereof, during such ten (10)
 21    day period. The place, hour and day of such hearing shall be specified in said
 22    notice, as well as the place where such budget may be examined prior  to  such
 23    hearing.  A  full and complete copy of such proposed budget shall be published
 24    with and as a part of the publication of such notice of hearing.
 25        (3)  Such budget shall be available for public inspection from  and  after
 26    the  date of the posting of notices of hearing as in this section provided, at
 27    such place and during such business hours as the board may direct.
 28        (4)  A quorum of the board shall attend such hearing and explain the  pro-
 29    posed budget and hear any and all objections thereto.
 30        (5)  The  fiscal  year of a fire protection district shall commence either
 31    on the first day of October of each calendar year, or on the first day of Jan-
 32    uary of each calendar year, as established by resolution of the  fire  protec-
 33    tion district board of commissioners.

                       STATEMENT OF PURPOSE
                             RS 14463

The purpose of this legislation is to amend Section 31-1419A,
Idaho Code, to provide that the fiscal year of a Fire Protection
District shall commence either on the first day of October of
each calendar year or on the first day of January of each
calendar year, as established by resolution of the Fire
Protection District Board of Commissioners.


                           FISCAL NOTE

There will be no impact to the General Fund.
